The principle of national Judges applies under the Statute (Art. 31) of the International Court of Justice. Judges of the nationality of parties before the Court retain their right to sit in the case; if the Court includes a Judge of the nationality of one party, any other party may choose a person to sit as Judge, and if the court does not include Judges of the Nationality of the parties, each of the parties may proceed to appoint as Judge ad hoc a person of its nationality. 1, record 2, English, - judge%20ad%20hoc

Lorsque, dans une affaire soumise à la Cour, les parties, ou l'une d'entre elles, n'ont pas de juge de leur nationalité sur le siège, elles ont la faculté de désigner pour cette affaire un juge ad hoc. (art. 31(3) du Statut). Celui-ci participe à la décision dans des conditions de complète égalité avec ses collègues. Le juge ad hoc peut n'avoir pas la nationalité de la partie qui le désigne.
