Il y a témoignage lorsque quelqu'un fait une déclaration sous serment devant une instance judiciaire et qu'il jure de dire la vérité sur un fait. Alors que la déposition n'exige pas de prestation de serment lorsque la personne fait une déclaration sur un fait quelconque.
