L'avant-projet ramène le contenu de la notion de choses hors commerce à de plus justes proportions. L'article 3056 les distingue à bon droit de ce qui est extrapatrimonial, d'une part et des « choses qui, par leur nature, sont non susceptibles d'appropriation », d'autre part, c'est-à-dire les choses communes. Seront donc proprement considérées comme choses hors commerce, et à ce titre imprescriptibles, les choses qu'une loi spéciale déclare hors commerce, telles les substances dangereuses, les drogues, le gibier et certaines armes. Le corps humain et sa dépouille mortelle sont aussi des choses hors commerce conformément au principe de l'indisponibilité de la personne humaine.
