The Divorce Act provides that spouses are deemed to have lived separate and apart for any period during which they lived apart and either of them had the intention to live separate and apart from the other. The expression "separate and apart" is not defined in the Act, but a review of the case law indicates that it requires physical separation coupled with a recognition by one of the parties that the marriage is at an end. 3, record 1, English, - live%20separate%20and%20apart
