OBS

Established on 1 January 1995, is the legal and institutional foundation of the multilateral trading system. It provides the principal contractual obligations determining how governments frame and implement domestic trade legislation and regulations. The WTO is the embodiment of the results of the Uruguay Round trade negotiations and the successor to General Agreement on Tariffs and Trade (GATT).

"WTO is GATT plus a lot more. ... It is probably best to be clear from the start that the GATT was two things: (1) an international agreement, and (2) an international organization created later to support the agreement. The text of the agreement could be compared to law, the organization was like parliament and the courts combined in a single body. ... GATT, the international agency, no longer exists. It has now been replaced by the WTO GATT, the agreement, does still exist, but it is no longer the main set of rules for international trade. And it has been updated. ... While GATT no longer exists as an international organization, the GATT agreement lives on. The old text is now called "GATT 1947". The updated version is called "GATT 1994".

The Organization was first proposed in the 1940s as ITO but not realized. GATT was a forerunner, established 1 January 1948.

Créée le 1er janvier 1995, l'OMC est le fondement juridique et institutionnel du système de commerce multilatéral. Elle concrétise les principales obligations contractuelles qui déterminent comment les gouvernements doivent formuler et appliquer leurs lois et règlements internes en matière de commerce. L'OMC est l'aboutissement du Cycle d'Uruguay et succède à l'Accord général sur les tarifs douaniers et le commerce(GATT).

L'OMC, c'est le GATT et bien plus encore. ... Il faut peut-être préciser tout de suite que le GATT était deux choses à la fois : 1) un accord international et 2) une organisation internationale créée par la suite pour administrer l'Accord. On peut comparer le texte de l'Accord à une loi et l'Organisation à un organisme jouant à la fois le rôle d'un parlement et celui d'un tribunal. [...] Le GATT, en tant qu'organisation internationale, n'existe plus. Il est aujourd'hui remplacé par l'OMC. Le GATT, l'accord, existe toujours, mais il n'est plus le principal ensemble de règles régissant le commerce international. Il a également été mis à jour. [...] L'accord qui correspond à ce sigle est toujours en vigueur. L'ancien texte s'appelle aujourd'hui «GATT de 1947». La version actualisée est dénommée «GATT de 1994».

L'acronyme français, AGETAC, pour «Accord général sur les tarifs douaniers et le commerce», équivalent du GATT recommandé par arrêté ministériel du 18 février 1987, ne s'est pas imposé. Le sigle anglais est donc conservé en français lorsque l'équivalent français manque d'euphonie ...».

La OMC, establecida el 1° de enero de 1995, conforma la base jurídica e institucional del sistema multilateral de comercio. De ella dimanan las principales obligaciones contractuales que determinan la manera en que los gobiernos configuran y aplican las leyes y reglamentos comerciales nacionales. La OMC es la encarnación de los resultados de las negociaciones comerciales de la Ronda Uruguay y la sucesora del Acuerdo General sobre Aranceles Aduaneros y Comercio (GATT).

Es necesario aclarar desde el comienzo que el Acuerdo General sobre Aranceles Aduaneros y Comercio (GATT) era dos cosas a la vez: 1) un acuerdo internacional, [y] 2) una organización internacional creada posteriormente para prestar apoyo al acuerdo. El texto del acuerdo podía compararse a un instrumento legislativo y la organización era semejante a un Parlamento y a un poder judicial reunidos en un órgano único. [...] El GATT, organismo internacional, ya no existe. Ha sido sustituido por la OMC. Comercio. El GATT, el acuerdo, sigue existiendo, pero ya no es el principal conjunto de normas que regulan el comercio internacional. Además, ha sido actualizado. El GATT ya no existe como organización internacional,; el Acuerdo del GATT sigue existiendo. El antiguo texto se denomina actualmente "GATT de 1947". La versión actualizada se denomina "GATT de 1994".
