Standing Offers. Standing Offers are used to meet recurring needs when departments or agencies repeatedly order the same goods or services. A request for standing offer(RFSO) is used to solicit standing offers. Suppliers who meet the evaluation criteria stated in the RFSO become pre-qualified suppliers and holders of standing offers. A standing offer is an offer from a potential supplier to provide goods and/or services at pre-arranged prices, under set terms and conditions, when and if required. It is not a contract until the government issues a "call-up" against the standing offer. The government is under no actual obligation to purchase until that time. 2, record 2, English, - request%20for%20standing%20offer

Such conduct is sometimes called "anticipatory breach". The other party then has a choice. He can try to keep the contract alive by continuing to press for performance, in which case the anticipatory breach will have the same effects as an actual breach. Where a party fails to perform one of his obligations, that may be called actual breach; where he evinces an intention not to perform, that may be called anticipatory breach. Actual breach may take one of three forms. Non-performance is one form of breach. Suppose A, a shipowner, charters his ship to B, undertaking to have the ship at Liverpool for loading by a certain date. If A(perhaps because he has received a more profitable offer from C in Southampton) never takes his ship to Liverpool, that is a breach of contract by non-performance. Another form of actual breach is defective performance. If A attempts to get his ship to Liverpool, but arrives late, that is a breach of contract by defective performance. A third form of actual breach is the non-truth of a statement which is a term of the contract. If it is written into the contract that the ship is suitable for carrying motor-cars, and in fact it is not, that is a breach of contract. 2, record 17, English, - actual%20breach

Doctrine of Anticipatory Breach... One of the parties to a contract may, before the time fixed for performance, say that he will not perform, or incapacitate himself from performing. Such conduct is sometimes called "anticipatory breach. "The other party then has a choice. Notice of certain facts that may be discovered by diligence or inquiry into a public record; a legal presumption that a person is responsible for knowing these facts. The proper recording of a document gives constructive notice to the world of the document's existence and contents. Possession of property also imparts constructive notice of the rights of the party in possession. Examples of rights of parties in possession would be rights under an unrecorded deed, contract for deed, lease-option, and rights of adverse possession. Split Equity Contract similar to the en viager method used in France, involves the actual sale of the property by the homeowner. There is no mortgage. The homeowner retains the right to rent-free occupancy for a specified number of years or life. The purchase price would be determined by the expected future value of the property discounted by its rent-free use, interest, and the specific or expected time lapse before actual possession. This could be a life mortality consideration. The proceeds of the sale could be invested to yield income or, alternatively, used to buy a Life Annuity from an insurance company. 2, record 42, English, - split%20equity%20contract
