Upon the service upon the party or witness of an order referred to in section 43, and of an appointment of a time and place for the examination of such party or witness signed by the person named in the order for taking the examination, or, if more than one person is named, then by one of the persons named, and upon payment or tender of the like conduct money as is properly payable upon attendance at a trial, the order may be enforced in like manner as an order made by the court or judge in a cause pending in such court or before such judge.

In most provinces the practice is to appoint the federally appointed County(or District) Court judge or judges to be judges of the Surrogate Court for the County(or other territorial jurisdiction).(Feendy, 2nd, v. 1, p. 135)

The Judge Advocate of Her Majesty's Fleet is a civilian circuit judge who is responsible for the supervision and superintendence of court-martial system in the Royal Navy. Responsibility for the naval court-martial system was formerly shared with the Chief Naval Judge Advocate, a legally-trained serving naval officer who was responsible for the appointment of judge advocates, but that position was abolished in 2004 as a result of ruling by the European Court of Human Rights that held that as a serving naval officer his position was insufficiently neutral. The office of Judge Advocate of the Fleet will be merged with the office of Judge Advocate General under the Armed Forces Act 2006.
