A weekly or other periodic tenancy is a tenancy by the week or the period, and does not expire without notice at the end of the first week or period or at the end of each succeeding week or period, there being not a reletting at the beginning of every week or period but a springing interest which arises and which is only determined by a proper notice to quit. The period upon which a tenancy is based may be ascertained mainly by reference to the way in which the rent is calculated; thus, where the rent reserved is so much per year, a yearly tenancy will be implied, even though the rent is payable monthly. There is a distinction between a monthly or quarterly rent and monthly or quarterly instalments of a yearly rent; and accordingly, where a tenant for a fixed-term at a weekly rent holds over and continues to pay the same weekly rent, the proper inference is that a weekly tenancy was intended.(Evans, 1974, p. 32). 1, record 16, English, - weekly%20tenancy

Under the old law, a deed could not be delivered, as an escrow, direct to the grantee. Delivery in escrow was made to a third party-the first delivery-and, upon the fulfilment of the condition, the third party would deliver the deed to the grantee-the second delivery. It seems that the old law no longer applies. The more modern approach is to treat the question as one of fact; even where there is delivery to the grantee, the intention of the parties must be ascertained, from the transaction as a whole, as to whether the delivery was absolute or conditional.(Mendes da Costa and Balfour, p. 401) 1, record 18, English, - delivery%20in%20escrow

Gifts expressed in the alternative. Two or more gifts may be made to take effect alternatively, for example, in certain mutually exclusive events; thus, a gift to A or B, where A and B are donees, described or named, and mutually exclusive, is an alternative gift. In such a gift there is generally a contingency implied, even if not expressed, on the happening of which the gift is to take effect in favour of the second-named donee, and the circumstances of the gift must be ascertained before the contingency can be determined. Usually it refers to the death of the first-named donee before some particular period; for example, the death of the testator or some other period of distribution; and it is inferred that the intention of the testator is that the first donee shall take if then alive, but that the second donee is to take if the first does not survive the particular period.(Halsbury's Laws of England, 3rd ed., v. 39, 1962, p. 1048) 1, record 20, English, - alternative%20gift

Determination of refugee status is a process which takes place in two stages. Firstly, it is necessary to ascertain the relevant facts of the case. Secondly, the definitions in the 1951 Convention and the 1967 Protocol have to be applied to the facts thus ascertained. 5, record 28, English, - determination%20of%20refugee%20status

Due to the fact that the [determination of refugee status] is not specifically regulated by the 1951 Convention, procedures adopted by States parties to the 1951 Convention and to the 1967 Protocol vary considerably. In a number of countries, refugee status is determined under formal procedures specifically established for this purpose. In other countries, the question of refugee status is considered within the framework of general procedures for the admission of aliens. In yet other countries, refugee status is determined under informal arrangements, or ad hoc for specific purposes, such as the issuance of travel documents. 5, record 28, English, - determination%20of%20refugee%20status

Once the normalized intensity at diffraction focus has been determined, the quality of the optical system may be ascertained using the Marechal criterion. The Marechal criterion states that a system is regarded as well corrected if the normalized intensity at diffraction focus is greater than or equal to 0. 8, which corresponds to an rms wavefront error [lambda]/14. 1, record 40, English, - Marechal%20criterion

The related rules concerning the intention of the parties proceed from the capital principle that it is to the intention of the parties at the time the instrument was concluded, and in particular the meaning attached by them to words and phrases at the time, that primary regard must be paid. Hence, it is legitimate to consider what was the "purpose" or "plan" of the parties in negotiating the treaty. Nor should a treaty be interpreted so as to restrict unduly the rights intended to be protected by it. What must be ascertained is the ostensible intention of the parties, as disclosed in the four corners of the actual text; only in exceptional circumstances is it permissible to investigate other material to discover this intention. Moreover, a special meaning must be given to a particular term, if it is established that the party so intended. 2, record 49, English, - intention

The energy for complete fracture in double edge-notched tension test specimens has been measured for a wide range of polymer films. Results indicated that the variation of the total specific work of fracture, wT, with ligament length, L, can be described by two straight lines, both of the form wT=we+β wpl, thus giving upper and lower intercept values at zero ligament length(i. e. we) for each film. The first term, we, is the energy absorbed per unit area of fracture, whereas the second term, wp, is the energy absorbed per unit volume of plastic deformation remote from the fracture surface. The lower we value was obtained from the extrapolation of the data within the mixed mode region(plane-stress/plane-strain) where the maximum net-section stress exceeded 1. 15 times that of the tensile yield stress, σy, of the material, and the upper value was ascertained by extrapolating the data within the plane stress region where the net-section stress was 1. 15 σy. It appears that the transition from plane stress to plane strain mode of fracture in thin films occurs at a ligament length much greater than 5B, where B is the specimen thickness. 1, record 53, English, - stress%20region

The assurance provided by any... security services... can be ascertained by determining the strength and correctness of the mechanism that provides the service. For physical, administrative, and procedural mechanisms, the assurance level is determined by reviewing the processes that are implemented. For electronic mechanisms, empirical or exhaustive techniques are generally used... Possible, but not assured; doubtful or uncertain; conditioned upon the occurrence of some future event which is itself uncertain, or questionable.... this term, when applied to a use, remainder, devise, bequest, or other legal right or interest, implies that no present interest exists, and that whether such interest or right ever will exist depends upon a future uncertain event. An interest is contingent or executory if it does not satisfy one of these three criteria, for in that case it is not presently capable of falling into possession upon the natural determination of all preceding interests.(Anger & Honsberger, 2nd d. 1985, p. 350) 1, record 60, English, - contingent

In a single-crystal blade casting, the first element to solidify is a "starter block" attached to the root of the [turbine] blade by a narrow helical passage in the mould. The helical passage obstructs the growth of multiple crystal boundaries, with the result that the blade is formed from a single crystal. This crystal propagates in two halves around the strong-back. The two halves of the blade can then be joined by a process called "transient liquid phase" bonding, in which the halves are mated around a foil "gasket" of the same alloy as the blade--coated with boron to reduce its melting point--and joined under pressure. The gasket and the thin layer of metal immediately adjacent to it melt, the boron dissipates completely and the part solidifies while still under pressure.
