Basically, registering a copyright creates a public record of the creation of the work. This public record may be usable as prima facie evidence in a court case involving copyright infringement. Further, more monetary damages are awarded to the registered copyright in a court action--statutory damages, attorney's fees, actual damages and profits--as compared to only actual damages and profits in the case of the unregistered copyright.

To adopt a trademark, a thorough search should be done to determine that nobody has already taken that idea, then an application should be filed with the trademark office.

If you adopt a mark that is confusingly similar to an existing mark, then you may be liable for trademark infringement, with the possible consequences ranging from having to give up all use of your mark, to having to pay treble damages, attorneys fees, court costs, and prejudgment interest.
