Record 1 2013-06-25

English

Subject field(s)
  • PAJLO
  • Property Law (common law)
OBS

A legacy payable at a future time, certain to arrive, and not subject to conditions precedent, is vested, where there is a person "in esse" at the testator's death capable of taking when the time arrives, though his interest may be altogether defeated by his own death.... Thus a legacy to one to be paid when he attains the age of twenty-one years is a vested legacy, because it is given unconditionally and absolutely, and therefore vests an immediate interest in the legatee, of which the enjoyment only is deferred or postponed.(Black's, 5th ed., 1979, p. 1402)

CONT

(I) f it is clear from the language of the will that the attainment of a certain age is made a condition precedent to the vesting of a legacy, such legacy will be contingent notwithstanding a gift of the legacy distinct from the direction to pay; so that a gift to A, to be paid in case he attained the age of twenty-one and not otherwise, is contingent upon A's attaining that age.("Jarman on Wills", 8th ed., 1951, p. 1390)

CONT

Conditional Legacies. Where a legacy is given subject to the fulfilment of a certain condition the legacy is said to be conditional, e. g. a gift conditional on a son entering his father's business. The condition must be possible of fulfilment, however, and thus a condition imposed on a legatee to climb Mount Everest in one day could not be upheld.

French

  • Droit successoral (droit civil)
  • Droit successoral (common law)
OBS
