One trained and licensed to prepare, manage, and either prosecute or defend a court action as an agent for another and who also gives advice on legal matters that may or may not require court action. Many of the terms listed above may be used interchangeably depending on the jurisdiction. These titles, and the rank and powers attributed to them, vary significantly from province to province and from state to state, thus necessitating a careful check of the pertinent jurisdiction's usage before choosing a term for a legal text. The following trends may be noted. "Lawyer" is a generic term. "Counsel", frequently used in Canada, may be a general term, or may refer more specifically to a lawyer who can plead in court. A "barrister" is a courtroom lawyer as opposed to a "solicitor" who is basically an office lawyer.(In Canada, both of these functions may be carried out by the same person). In some jurisdictions, "attorney" is used as a synonym of "lawyer", but in others, "attorney" becomes synonymous with "solicitor". Moreover, an "attorney-at-law" may sometimes plead in court. "Advocate" is the general word for a lawyer in Roman law jurisdictions(i. e. Quebec).

On dit une avocate pour une femme ou un avocat. «Conseil» est rare et ne se dit que d'un avocat qui défend les intérêts d'une personne en dehors de toute action judiciaire. Le terme «avoué», désignant un officier ministériel qui représente les parties devant les tribunaux et fait les actes de procédure, n'est pas employé au Canada.
