The concept of due process is rooted in English common law and expressed in "Magna Carta", Art. 39 (1215), whereby the King promised that ’No freeman shall be taken or imprisoned or disseised or exiled or in any way destroyed ... except by the legal judgment of his peers or by the law of the land’. This was later interpreted to require trial by jury. 4, record 1, English, - due%20process%20of%20law
Record number: 1, Textual support number: 2 CONT
"Due process" is an imprecise and elastic term, the meaning of which varies with time and place. Basically, it suggests fundamental fairness and tries to apply that concept to all parts of the criminal process. The breadth of the concept depends upon the subjective view of the American courts, particularly the United States Supreme Court. In the last twenty years "due process" has included protections against self-incrimination, coerced confessions, illegal searches, denial of counsel or jury trial and unregulated eavesdropping. In the American system a judicial finding that law enforcement officials have offended due process will result in a complete exclusion of the impugned evidence and will usually result in the acquittal of the accused.

The Terrorist and Disruptive Activities(Prevention) Act, commonly known as TADA, was an Indian law active between 1985 and 1995(modified in 1987) for the prevention of terrorist activities in Punjab. It was renewed in 1989, 1991 and 1993 before being allowed to lapse in 1995 due to increasing unpopularity due to widespread allegations of abuse. The drawback was that it didn’t provide a definition of the term "terrorist". The Act does not define the term "terrorist". It presumed that the accused was guilty. It had a conviction rate of less than 1% despite the fact that, under criminal law, a confession before a police officer, even though being given under torture, was admissible as evidence in court. A special court known as TADA court was set up to hear the cases and deliver judgements pertaining to 1993 Bombay bombings. 1, record 55, English, - Terrorist%20and%20Disruptive%20Activities%20%28Prevention%29%20Act

Minimization procedures are designed to prevent the broad power of "foreign intelligence gathering" from being used for routine criminal investigations. In a number of instances, however, there are overlaps between foreign intelligence gathering and criminal investigations. One common minimization procedure is what is known as an "information-screening wall. "These "walls" require an official not involved in the criminal investigation to review the raw materials gathered by FISA [Foreign Intelligence Surveillance Act] surveillance and only pass on information that might be relevant evidence. The purpose is to ensure that criminal investigators do not use FISA authority for criminal investigations. 1, record 57, English, - minimization%20procedure
