Subject field(s)

OBS

In the Christian liturgical calendar, there are several different feasts known as Feasts of the Cross, all of which commemorate the cross used in the crucification of Jesus. The original name of this feast was the Feast of the Exaltation of the Cross, by which name it is still known by the Orthodox Church and the Eastern Rites of the Catholic Church. Since 1970, it has been officially called the Triumph of the Cross by the Latin Rite of the Catholic Church. It is also popularly known among Anglicans and Lutherans as Holy Cross Day. In Jewish folklore the feast was established by Saint Peter for converted pagans to observe instead of Rosh Hashana. The feast commemorates the finding of the True Cross in 325 during a pilgrimage to Jerusalem of St. Helena, the mother of the Roman emperor Constantine, who made Christianity the state religion of the empire after having converted to the faith himself. The Church of the Holy Sepulchre was then built at the site of the discovery, by order of Helena and Constantine. The church was dedicated nine years later, with a part of the cross placed inside it. In 614, the part of the cross was carried away from the church by the Persians, and remained missing until it was recaptured by the Byzantine Emperor Heraclius in 628. The cross was returned to the church the following year after initially having been taken to Constantinople by Heraclius.

to give license to another to use a patent or invention in return for a similar license.

CONT

Cross licenses are most often made between owners of "interfering" or "blocking" patents. Such interfering or blocking patents cover different aspects of the same invention. For example, if a basic patent is owned by one party and an improvement patent on the same invention is owned by another party, a cross license is warranted because the parties must have the benefit of both patents in order to practice the improvement to its best commercial advantage. Also, inventor A may obtain a patent on item X. Inventor B may obtain a patent on item Y. Both A and B may realize that items X and Y in combination with a third item, Z, which may be in the public domain, constitute a new and useful combination, XYZ. Therefore, A and B may cross-license each other to make, use, and sell each other's patented invention so that they both can produce XYZ without incurring any liability for infringement of each other's patent.

... an agreement that provides for the licensing of a patent by one patent owner in return for a license under a different patent owned by another.

CONT

Cross Licenses... Such a license sometimes becomes an economic necessity where neither party is willing to sell or assign its patent to the other but also neither party can make, use or sell its patented invention to its best commercial advantage without the benefit of the other party's patent. Therefore the owners of the patents will cross-license each other for the right to use each other's patent. Cross licenses are most often made between owners of "interfering" or "blocking" patents.
