Several Justices of the Supreme Court of Canada... expressed their displeasure with the stalemate rule and turned a "wistful eye" to the more "equitable" Quebec principle of "common fault. "In one of those rare occasions in Canadian history when common lawyers were influenced by civil law, Ontario enacted the first apportionment statute a year later in 1924.

The Court... concluded that under equitable indemnity, a tortfeasor can obtain indemnity on a comparative fault basis from other concurrent tortfeasors. These principles apply to strict liability, as well as to negligence liability. This Court felt that indemnity should only be allowed on a comparative fault basis. Thus, that principle, rather than joint and several liability, should control the apportionment of loss among joint tortfeasors in a strict liability situation.

"Bi-junction" heating has been designed in order to obtain the most equitable apportionment of the heating charges for each occupant in accordance with the desired degree of heating comfort.

OBS

A "bi-junction" heating system comprises a first, collective, power supply circuit, which ensures a minimum basic temperature (generally 15 degree C) in all the apartments of the building, said temperature being maintained with the aid of a thermostat whose control point cannot be adjusted by the user. A second, individual, heating circuit can be switched on by the occupant of an apartment who requires a higher temperature in his apartment, the corresponding amount of power being recorded by an individual meter.
