Equity arbitration relies on both equitable ideals and universal common law principles that have developed through the years. For example, a valid contract requires that one party made an offer, the other accepted it, and something of value was exchanged. If the parties never reached an agreement, there is no contract... In equitable arbitration, the arbitrator doesn’t have to follow legal technicalities or enforce parts of a contract that don’t make sense. The arbitrator can ignore certain terms that would make the outcome unfair if they were strictly enforced. 3, record 2, English, - equitable%20arbitration

Although there are many executory contracts equity will not enforce specifically, contracts for the sale of land have generally been held to be specifically enforceable. Maitland had said that "specific performance applies to agreements for the sale or lease of land as a matter of course" and this conclusion has been reiterated by the Supreme Court of Canada. The traditional view that ordinarily damages would not be an adequate remedy for breach of a contract for the sale of land is based on the assumption that each parcel of land is unique and thus damages would not permit the plaintiff purchaser to find a substitute.(Anger and Honsberger, 2nd, p. 1153) 2, record 5, English, - specific%20performance

Extinguishment. The term has, in the law, no fixed, uniform and universal meaning, but varies with the subject matter to which it is applied; but usually it connotes the end of a thing, precluding the existence of future life therein, and has been defined generally as meaning a complete wiping out, destruction, or annihilation, and not a mere suspension; the destruction or cancellation of a right, power, contract, or estate; a discharge by operation of law; a termination; and, more specifically, as the annihilation or extinction of a right by its being consolidated with a greater or more extensive right; the extinction of a charge or equity by its passing into the hands of the owner of the lands charged; and it has been sometimes used in the sense of payment.("Corpus Juris Secundum", Vol. 35, p. 352) 1, record 11, English, - extinguishment

(extinguishment; extinction:) Both words are nouns corresponding to the verb "to extinguish". If there is differentiation, it is that extinguishment refers to the process, and extinction to the resultant state. A purchaser under contract to buy land had... at common law only a right to damages if his vendor broke the contract. But in equity he had a right to compel his vendor to convey the land itself. This right to specific performance created a right in the land, a species of equitable property right. Therefore, if A agreed to sell land to B,... B was equitable owner from the time of the contract, and could enforce his equitable right to the land against anyone except a "bona fide" purchaser of a legal estate without notice of the contract.(Megarry & Wade, 4th ed., 1975, p. 132) 1, record 13, English, - equitable%20property%20right

Split Equity Contract similar to the en viager method used in France, involves the actual sale of the property by the homeowner. There is no mortgage. The homeowner retains the right to rent-free occupancy for a specified number of years or life. The purchase price would be determined by the expected future value of the property discounted by its rent-free use, interest, and the specific or expected time lapse before actual possession. This could be a life mortality consideration. The proceeds of the sale could be invested to yield income or, alternatively, used to buy a Life Annuity from an insurance company. 2, record 24, English, - split%20equity%20contract
