Foreclosure results in a loss for the lender and is obviously quite detrimental to the borrower; as a result, it is the last resort. Most of the time, lenders attempt to work with the borrower to come up with a better solution, such as extending the repayment period in order to lower payments. 2, record 1, English, - foreclosure

When the landowner defaulted, courts of equity were again asked to respond, and developed the system of equitable foreclosure. The landowner's failure to repay the loan no longer resulted in an automatic forfeiture of their ownership interest in the land to the lender. Instead, the lender would have a right to petition a court for a decree of foreclosure, the granting of which would bar the landowner's right to the equity of redemption. The lender would thereby recoup his investment by taking title and possession of the property if the landowner failed to repay the loan within a time fixed by the court. The equitable foreclosure system was slow but fair : the lender could petition the court to give ownership of the land to the lender to repay the loan, but the landowner would have a chance to remedy the default or explain the default when the lender had not behaved reasonably. 2, record 5, English, - equitable%20foreclosure

The Court also distinguished between the legal right of redemption in foreclosure proceedings and a borrower's contractual right to reinstate a defaulted loan. By law, a defaulting borrower in foreclosure is entitled to redeem his or her property by paying the entire principal and interest due before confirmation of the sheriff's sale. When that happens, the lender has a legal duty to dismiss the foreclosure proceedings and may not condition that dismissal on payment of attorney fees. This differs from a contractual right to reinstate a loan. In that instance, the borrower typically pays only the amounts needed to make the loan current and continues all future payments on the previously agreed-upon schedule. 3, record 9, English, - legal%20right%20of%20redemption

There is no doubt that under a common-law mortgage the debt did not become extinguished by a foreclosure order. As is well known the old mortgage, which has been known for hundreds of years, was a conveyance of the land to the mortgagee, subject to certain rights on the part of the mortgagor. If the mortgagor failed to pay according to the terms of the mortgage he lost his rights and the mortgagee became the absolute owner of the lands without more. 3, record 15, English, - common%2Dlaw%20mortgage

2, record 15, French, - hypoth%C3%A8que%20en%20common%20law

The [Iowa Supreme Court] affirmed the trial court's refusal to render a foreclosure decree ordering a sale of the property involved to repay the mortgage held by the plaintiff and pointed out that the Iowa code expressly required the filing of the instrument, the copying of the instrument into the record book, and the indexing of the instrument. Relying on the purposes for the establishment of a system of recordation, the court interpreted the legislative intent as requiring the indexing of an instrument before there could be valid recordation.(Axelrod, Berger and Johnstone, 1971, pp. 552-553). 1, record 18, English, - indexing
