The Court also distinguished between the legal right of redemption in foreclosure proceedings and a borrower's contractual right to reinstate a defaulted loan. By law, a defaulting borrower in foreclosure is entitled to redeem his or her property by paying the entire principal and interest due before confirmation of the sheriff's sale. When that happens, the lender has a legal duty to dismiss the foreclosure proceedings and may not condition that dismissal on payment of attorney fees. This differs from a contractual right to reinstate a loan. In that instance, the borrower typically pays only the amounts needed to make the loan current and continues all future payments on the previously agreed-upon schedule. 3, record 3, English, - legal%20right%20of%20redemption

The [Iowa Supreme Court] affirmed the trial court's refusal to render a foreclosure decree ordering a sale of the property involved to repay the mortgage held by the plaintiff and pointed out that the Iowa code expressly required the filing of the instrument, the copying of the instrument into the record book, and the indexing of the instrument. Relying on the purposes for the establishment of a system of recordation, the court interpreted the legislative intent as requiring the indexing of an instrument before there could be valid recordation.(Axelrod, Berger and Johnstone, 1971, pp. 552-553). 1, record 9, English, - indexing

The lender is limited to a foreclosure(a quick private sale or a judicial foreclosure along with a deficiency judgment). This is the one authorized action that a secured lender may properly take, and the entire concept is referred to as the one-action rule. If the lender violates the rule, it might find itself unable to proceed against the borrower at all, or at best it will become an unsecured creditor. 1, record 10, English, - authorized%20action

Once the mortgagor has made default in payment of the mortgage debt, the mortgagee is entitled to pursue any or all of his remedies... Hence the mortgagee can at the same time sue for payment on the covenant to pay principal and interest, for possession of the mortgaged estate, and for foreclosure... If the mortgagee realises part of the debt by his action on the covenant, or by sale of part of the property, he must give credit in the foreclosure action for the amount realised, and if, after foreclosure, he proceeds on the covenant, he re-opens the foreclosure. 2, record 11, English, - action%20on%20the%20covenant
