A foreign trust is an entity organized outside Canada which is set up to hold and administer funds or property on behalf of beneficiaries. Adopted by UNCITRAL [United Nations Commission on International Trade Law] on 30 May 1997, the Model Law is designed to assist States to equip their insolvency laws with a modern, harmonized and fair framework to address more effectively instances of cross-border insolvency.
