The bad-faith joinder of a party, usually a resident of the state, to prevent removal of a case to federal court.

CONT

In order to defeat federal court jurisdiction, it is improper but possible for a complaint to be filed in state court naming a non-diverse defendant "fraudulently, "i. e., naming a defendant against whom a good faith claim could not be asserted solely for the purpose of defeating federal court jurisdiction. An action wherein "fraudulent joinder" has occurred may nonetheless be removed. Fraudulent joinder is a judicially created exception to the requirement of complete diversity.

The joinder of alternative claims, such as breach of contract and quantum meruit, or of one claim with another prospective claim, such as a creditor’s claim against a debtor to recover on a loan and the creditor’s claim against a third party to set aside the transfer of the loan’s collateral.

Joinder of remedies. A joining of two claims in one action even though one cannot be recognized until the other is resolved. Specifically, the combination of legal and equitable claims in one action when a fraudulent conveyance must first be set aside legally before equitable relief can be granted to a creditor.
