Sometimes, however, when goods have been carried part of the way, and further prosecution of the voyage has become impossible, for instance because of a blockade or ice at the port of delivery, the goods’ owner will accept delivery at an intermediate port. The question then presents itself whether freight calculated "pro rata" for the voyage actually accomplished becomes payable.

Freight paid as a lump sum for the use of a ship, irrespective of the amount by the cargo loaded.

Where a lump sum freight is not stipulated, the carrier is only entitled to freight calculated "pro rata" on the quantity of cargo delivered, so that if there is short delivery the freight payable will be proportionately less.

Le forfait (on dit aussi dans le jargon maritimiste : «lumpsum» ou «lump freight») est dû par l'affréteur quelle que soit la quantité chargée, pourvu qu'elle ne dépasse pas celle qu'il a annoncée, compte tenu, au besoin, de la tolérance [...] Si par contre, l'affréteur chargeait plus qu'il n'était prévu (tolérance dépassée), il devrait un supplément de fret calculé en proportion du fret forfaitaire.
