Rather than foster full recognition of both English and French in Canadian society, the actions of the Department of Justice would result in diminished opportunities for their use. The breach of obligations under section 41 must also be seen in light of the principle of official language equality under section 16 of the Charter, as well as the recognition that governments in Canada should advance by way of legislative action the equality of status or use of French and English. The principle of equality of our official languages must have substantive effects in order to ensure its full implementation. This imposes a constitutional obligation on the federal government to take the initiative in creating a necessary institutional support to the use of either official language. This obligation is ignored by action that reduces the scope of language rights as they apply to the legal process under federal jurisdiction. 1, record 7, English, - by%20way%20of%20legislative%20action

...-Commissioner of Official Languages :"My understanding of linguistic equality is based on section 16 of the Charter [Canadian Charter of Rights and Freedoms]. It tells us that English and French are the official languages of Canada... This statement reflects our history and enshrines our linguistic diversity; it simultaneously establishes the foundation, and the framework, for today's language rights as a whole. Section 16 also envisages the Canada we must build. Over and above this, the Charter sets out a vision for our country. In the Beaulac decision, the Supreme Court of Canada told us that language rights "must in all cases be interpreted purposively, in a manner consistent with the preservation and development of official language communities in Canada. "Our objective, therefore, is the substantive equality of our English and French language communities, including an improved status for the minority language communities.

... a section of a city, primarily a residential area. It usually represents the service area of a high school, contains a business center, and commonly constitutes a section of the city measuring two or three miles across. It can be thought of as a "community of neighborhoods" because it is usually composed of three to five neighborhoods. The above definition describes the "community" as a physical entity and allows us to distinguish it from the "neighborhood unit" for purposes of defining planning areas in a city. Note however that the term also refers to a social reality usually including geographic territory, but more importantly involving people held together by psychological, sociological and/or economic bonds or by a common purpose. In this sense, it is not as closely associated to the idea of geographical proximity as either "neighborhood" or the French "quartier". Even in strict planning terms, "community" is a broader term than "quartier" in that it can also apply to entire cities or towns or, conversely, to small rural settlements. 1, record 28, English, - community

2, record 28, French, - quartier
