Frustration of purpose is, in a sense, the converse of impracticability. The two ideas resemble each other in that neither is concerned with cases in which performance has become impossible. Impracticability is said to arise when a supplier of goods, services or other facilities alleges that performance of his own promise has become so burdensome to him that he should no longer be bound to render it. The argument of frustration of purpose, on the other hand, is put forward by the recipient of the goods, services or facilities : it is that supervening events have so greatly reduced the value to him of the other party's performance that he should no longer be bound to accept and pay for it. 2, record 1, English, - frustration%20of%20purpose

The ship could have been sent in due course, but by the time it was ready and available the original purpose of the intended charter-party could not be fulfilled. Therefore, there was "practical" impossibility, or "frustration", even though there was no physical impossibility... The commercial purpose of the original contract has been frustrated; to go on when the delaying act or event has concluded its effects would be to bind the parties by a new contract, in new and different circumstances. 3, record 2, English, - practical%20impossibility
Record number: 2, Textual support number: 1 OBS
The current trend in the United States is to abandon the very word "impossible" and "impossibility" and to use instead the terms "impracticable" and "impracticability". This change seems, morever, to be intended to widen the scope of the doctrine of discharge by supervening events. 4, record 2, English, - practical%20impossibility
