The New West Partnership Trade Agreement(NWPTA) is an accord between the Governments of British Columbia, Alberta and Saskatchewan that creates Canada's largest, barrier-free, interprovincial market. Under the NWPTA, British Columbia, Alberta and Saskatchewan are the first jurisdictions to commit to full mutual recognition or reconciliation of rules that hinder the free movement of goods, services, investment, and people within Canada. The NWPTA builds on the Trade, Investment and Labour Mobility Agreement(TILMA) between British Columbia and Alberta and has the clarity Saskatchewan was seeking on public ownership of Crowns and the ability of municipalities to support economic development. The NWPTA comes into effect July 1, 2010 and will be fully implemented on July 1, 2013.

DEF

An interest in property other than full ownership, such as that of a bailee in possession, a lienor, a mortgagee, etc.(Ballentine's, 3rd ed., 1969, p. 1201)

OBS

"Special property" ... may mean that the subject-matter is incapable of being in the absolute ownership of any person. Thus a man may have a property in deer in a park, hares or rabbits in a warren, fish in a pond, etc.; but it is only a special or qualified property, for if at any time they regain their natural liberty his property instantly ceases, unless they have "animus revertendi". (A) person may have a special property in a thing in the sense that he can only put it to a particular use. Thus, in the case of a bailment, the bailee has a special property in the thing bailed, for he is only entitled to deal with it in accordance with the ... bailment.... OBS

Ownership, or the right of property is ... not a single indivisible concept but a collection or bundle of rights of legally protected interests. (Brown, 3rd ed., 1975, p. 6).

OBS

So long as we remember that the ownership of a material thing is nothing more than a figurative substitute for the ownership of a particular kind of right in respect of that thing, the usage is one of great convenience; but so soon as we attempt to treat it as anything more than a figure of speech, it becomes a fertile source of confusion of thought. (Salmond, "Jurisprudence", 8th ed., p. 279).

OBS

The doctrine of tenure... means that "land cannot be the subject-matter of ownership, though the person in whom its seisin is vested is entitled to exercise proprietary rights in respect of it". But anyone can have full ownership of chattels and forms of purely personal property.(Crossley Vaines, 5th ed., 1973, p. 40).

The free and full ownership by individuals of rights in land, which is the basis of real property law in the United States. By contrast, under the feudal system ownership of the land was vested in the king or sovereign. The king then alloted select land to his noblemen, chiefs, and others. Such allotments were on a revocable basis and only represented the right to administer or use the land.(Reilly, p. 21)
