It is sometimes difficult to determine whether a statement is a representation inducing the other party to contract, or a term or stipulation of the contract. It is the terms which give content to the parties’ agreement, and questions of whether a contract has been performed or breached commonly depend on ascertainment and interpretation of the terms agreed. Terms may be express, stated in the contract, or imported by reference to some other document where they are set out in full, or implied into the contract, by common law, by custom and usage, by statute, and in some other ways.(Walker, p. 1211) 2, record 9, English, - term

PISA assesses how far students near the end of compulsory education have acquired some of the knowledge and skills that are essential for full participation in society. In all cycles, the domains of reading, mathematical and scientific literacy are covered not merely in terms of mastery of the school curriculum, but in terms of important knowledge and skills needed in adult life. 1, record 11, English, - Programme%20for%20International%20Student%20Assessment

To overcome the shortcomings of the QALY [quality-adjusted life year]... propose a measure which does not constrain the relationship between quality and quantity and claim that it truly reflects a person's preferences over quantity and quality of life while retaining the intuitive appeal of the concept of the year in full health.... it is more consistent with EUT [expected utility theory] and hence with individuals’ preferences. To distinguish it from the QALY they have named their new measure the healthy year equivalent(HYE). It involves the valuation of whole health profiles, which vary in terms of the sequence and duration of health states. This is a more general measure of preferences than the QALY since it makes fewer assumptions. 5, record 12, English, - healthy%2Dyear%20equivalent

Internalization. In social psychological terms the adoption of attitudes or behavior patterns by an individual. Indeed much of socialization and education is involved with encouraging the individual to internalize the behavioral norms, morals and values of his or her group. A child's behavior is shaped and guided by example, encouragement, rewards and punishments, and hence directed into particular channels by external instruction and intervention. However, as the child develops he or she becomes able to give him or herself these instructions. Full internalization is reached when the behavior takes place not just because it is rewarded or punished, but because it is seen to be correct or appropriate. 4, record 14, English, - internalization

Pyrometallurgical processes … the challenge lies in the full separation, and full recovery, in terms of quantity, of actinides from the salt bath, upstream of refabrication. The process affording the highest potential, as regards carrying out this operation, is reductive chemical extraction by means of a molten metal. One binary system of interest, for such separation, is the aluminum–fluoride system : LiF–AlF3/Al–Cu(high selectivity with regard to extraction of actinides, compared with fission products, high actinide solubility in aluminum…). 1, record 15, English, - reductive%20chemical%20extraction

The Treaty of Versailles was a peace treaty that officially ended World War I. It was signed on June 28, 1919, exactly 5 years after the assassination of Archduke Franz Ferdinand, one of the events that triggered the start of the war. Although the armistice signed on November 11, 1918 put an end to the actual fighting, it took six months of negotiations at the Paris Peace Conference to conclude a peace treaty. Of the many provisions in the treaty, one of the most important and controversial provisions required Germany and its allies to accept full responsibility for causing the war and, under the terms of articles 231-248, disarm, make substantial territorial concessions and pay reparations to certain countries that had formed the Entente powers. 1, record 18, English, - Treaty%20of%20Versailles

Project Management Practice Standard-Section 3. 3. 5-Concept Design : in some instances, where projects are small or consist of engineered works(where preliminary studies have already been done), this sub-phase may be combined with 3. 3. 6 Design Development. However, where the project is large, complex or unique the Project Team may decide that it is more efficient and economical to discuss the merits of various design options, while the design is still in conceptual form. In the latter case, the objective of this sub-phase is to conceptually define the design concept and the class C cost estimate, and then to gain client and RPS approval prior to instructing the designers to develop a more refined design. Although the consultant and client may communicate directly, the Project Manager must manage the communication flow to control project commitments and to ensure that there is full understanding by both parties. This involves helping the client to analyze and to evaluate the consultant's enquiries, and then responding to the consultant in technical terms which satisfy specific design conditions. Once the consultant has fulfilled the requirement for submissions as specified in the Project Brief, and the client, the project team, the regulatory authorities and the RPS design authorities have accepted the final concept, the Project Manager ensures adequate documentation of these positions in a Conceptual Design Report. This report is formally signed off by all Project Team members. Thus, this sub-phase is completed when the Project Manager is convinced that the consultant has adequately addressed the needs of the client/owner within acceptable time, cost and quality parameters. Only then will the Project Manager allow the consultant to refine the concept in the Design Development phase. 2, record 31, English, - Conceptual%20Design%20Report
