Consent secured by force or threat of force is not acceptable, nor is consent extracted from someone who is under the influence of drugs. Mere economic duress, however, is not sufficient to obliterate an otherwise valid consent, but this conclusion is increasingly under attack.... Young children cannot give a valid consent. Their parents must do so on their behalf.... In Johnston v. Wellesley Hospital, a 20-year-old underwent an acne treatment by a dermatologist when the age of majority was 21 years. The court held that the consent was operative because the plaintiff was capable of fully appreciating the nature and consequences of the treatment and could, therefore, validly agree to it.

There are four basic requirements of valid consent: (1) it must be voluntary; (2) it must be given by a person with capacity to consent; (3) it must refer to both the treatment and the provider of the treatment; and, finally, (4) it must be informed.
