FUNDAMENTAL CAUSE [6 records]

Record 1 2024-03-27

English

Subject field(s)
  • War and Peace (International Law)
  • Military Law
CONT

Jus in bello, also referred to as international humanitarian law(IHL), applies to all warring parties irrespective of the reasons for the conflict. It does not speak to whether or not the cause of war is just. Instead, this body of law seeks to protect war victims and their fundamental rights, no matter to which party they belong.

CONT

Necessity and proportionality have always been core principles of both branches of the jus belli principles that apply to both the authority to employ military force and the regulation of actual employment. However, in the jus ad bellum context, they have never before been viewed as principles to regulate operational and tactical execution. Instead, in that context they frame the legality of national or multinational resort to military force in self-defense. Once the decision is made to employ force pursuant to this authority, the jus in bello variant of these principles (necessity of the mission and proportionality of collateral damage) operate to regulate the application of combat power during mission execution (in other words, they provide the foundation for the regulation of the application of combat power in the context of the self-defense-justified mission).

  • Guerre et paix (Droit international)
  • Droit militaire
CONT

CONT

... the UAB [University of Alabama at Birmingham] team probed deeper into the welding process and made a fundamental metallurgical discovery-constitutional liquid film migration-a phenomenon that Dr. Thompson says would not have been found without the Gleeble. In the 1980's, researchers working in solid state electronic devices discovered diffusion-induced grain boundary migration, in which diffusion of elements from the top layer of a device would cause the grain boundaries to move in unpredictable directions. Five years later, other investigators found that running a liquid along the grain boundary could also cause it to move. Then, in the course of their NASA-related research, Dr. Thompson and his colleagues discovered that liquid film migration of grain boundaries occurred naturally during welding as the result of precipitates liquating in the heat affected zone. The UAB team further found that the migration distance was an order of magnitude greater than previously observed and that new grains were actually formed during the process. Spurred on by this discovery, the UAB researchers looked at real-world welding processes and found that constitutional liquid film migration could be found there too.

Subject field(s)
  • Titles of Monographs
  • Zoology
OBS

The International Code of Zoological Nomenclature is a set of rules in zoology that have one fundamental aim : to provide the maximum universality and continuity in classifying all animals according to taxonomic judgment. The Code is meant to guide the nomenclature of animals, while leaving the zoologists some degree of freedom in naming and classifying new species. The rules in the Code determine what names are potentially valid for any taxon including the ranks of subspecies and superfamily. Its provisions can be waived or modified in their application to a particular case when strict adherence would cause confusion. Such exceptions are not made by an individual scientist, no matter how well-respected within his or her field, but only by the International Commission on Zoological Nomenclature(ICZN), acting on behalf of all zoologists.

OBS

  • Waste Management
  • Nuclear Waste Materials
  • Dredging
CONT

If the fundamental principle guiding management is only permanent disposal, then options for waste management will be very limited since all management solutions must meet the safety and environmental standards set out by regulatory authorities. For example, considerations of such factors as volume, the disruption which removal might cause, costs and local preferences may make long-term management in situ a practical option for some of the existing wastes. The Task Force feels the uranium mine and mill tailings and the phosphogypsum wastes are best dealt with in this manner and that in situ management should at least be considered for several other waste deposits...
