FUNDAMENTAL TERM [27 records]

Record 1 2026-01-08

English

Subject field(s)
  • Administrative Law
  • Rights and Freedoms
DEF

The conduct of legal proceedings according to established principles and rules which safeguard the position of the individual charged.

CONT

The concept of due process is rooted in English common law and expressed in "Magna Carta", Art. 39 (1215), whereby the King promised that ’No freeman shall be taken or imprisoned or disseised or exiled or in any way destroyed ... except by the legal judgment of his peers or by the law of the land’. This was later interpreted to require trial by jury.

CONT

"Due process" is an imprecise and elastic term, the meaning of which varies with time and place. Basically, it suggests fundamental fairness and tries to apply that concept to all parts of the criminal process. The breadth of the concept depends upon the subjective view of the American courts, particularly the United States Supreme Court. In the last twenty years "due process" has included protections against self-incrimination, coerced confessions, illegal searches, denial of counsel or jury trial and unregulated eavesdropping. In the American system a judicial finding that law enforcement officials have offended due process will result in a complete exclusion of the impugned evidence and will usually result in the acquittal of the accused.

Conceptually, the definition of systemic change is... consistent with the roots of the term in political activism, from civil rights to universal suffrage : Systemic change means that change has to be fundamental and affects how the whole system functions. It's about changes that spread and behaviours that become a new normal, rather than benefits remaining confined to a narrow group. This way, scarce aid resources can be leveraged to stimulate more inclusive growth across whole sectors; not just narrow segments.

Physical literacy is the motivation, confidence, physical competence, knowledge and understanding to value, and take responsibility for, engagement in physical activities for life.

OBS

The term "physical literacy" has had various definitions. In Canada, until recently, it has long been used to refer to "the fundamental physical skills that permit a person to move confidently and with control in a wide range of physical activities. "

DEF

  • Optics
DEF

A device that converts input power into a very narrow, intense beam of coherent visible or infrared radiation.

CONT

A laser is a maser which operates at optical frequencies. It is a device which produces an intense beam of visible or infrared coherent light by pumping atoms to ever higher energy levels and allowing them to oscillate in an optical resonator until the energy level is high enough that a constant stream of photons is emitted.

OBS

Some prefer the term "optical maser," in which the letter "m" stands for "molecular" instead of its originally assigned denotation of "microwave." While this viewpoint is logical, ... the word "laser" ... has the virtue of brevity and has won popular acceptance.

OBS

L. A. S. E. R [or LASER] is an acronym which stands for "Light Amplification by Stimulated Emission of Radiation, "a term which describes the fundamental operation of a laser.

DEF

DEF

DEF

A sub-discipline of electronic countermeasures which covers a range of techniques used with aircraft, ships and missiles, in order to make them less visible (ideally invisible) to radar, infrared and other detection methods.

CONT

Stealth technology has as its fundamental principle the prevention of detection by the enemy, and applies not only to aircraft as is commonly assumed, but also increasingly to naval vessels and to armoured vehicles, although in the latter cases, it is nascent technology upon which comment must be reserved. Stealth technology, therefore, does not simply mean the evasion by aircraft of radar through the reduction of radar signature. It also encompasses the reduction of an aircraft's visibility in other spectra, most notably acoustic, visual, and infra-red. Consequently the popular term "stealth technology" would perhaps be better referred to as "low-observable technology. "

OBS

It was the deliberations of [the third Special Committee] that finally achieved a definition acceptable to the international community as a whole and it was adopted without vote by the [General Assembly] in December, 1974.

OBS

A term fundamental to international argument, which, since the First World War, has come to replace the idea of an "offensive" act. All attempts to arrive at a definition are motivated by the desire to outlaw aggressive war, under the supposition that if there were no aggressors, but only states for "self-defense", then there would be no wars. Accountability out is something different. It was defined in our Round Table as the sense of responsibility that one feels to the law, or to one's sense of personal or professional ethics. Accountability in this sense is a check on behaviour that is imposed either externally(i. e., through obligations flowing from laws or regulations) or internally(i. e, through a sense of personal obligation to abide by a self-imposed standard of conduct). This sense of accountability, if that is not stretching the term too far, is also familiar to anyone who works within an institutional framework and, indeed, is fundamental to any broader account of law and morality.
