FUTURE DAMAGES [12 records]

Record 1 2024-01-18

English

Subject field(s)
  • Personal Esthetics
  • Lasers and Masers
CONT

During laser hair removal, a laser emits a light that is absorbed by the pigment(melanin) in the hair. The light energy is converted to heat, which damages the tube-shaped sacs within the skin(hair follicles) that produce hairs. This damage inhibits or delays future hair growth. Although laser hair removal effectively delays hair growth for long periods, it usually doesn’t result in permanent hair removal.

... the word "anticipatory" describes the fact that the promisee's damages are assessed by reference to those obligations which would have fallen due for performance at some time in the future.

Where such an election is made (a) there is substituted by implication of law for the primary obligations of the party in default which remain unperformed a secondary obligation to pay monetary compensation to the other party for the loss sustained by him in consequence of their non-performance in the future and (b) the unperformed primary obligations of that other party are discharged. This secondary obligation is additional to the general secondary obligation; I will call it "the anticipatory secondary obligation".

The doctrine of "continuous trespass" applies only to omissions to remove something which has been brought on land and wrongfully left there; it does not extend to other cases where a defendant fails to restore the land to the same condition in which he found it, there the plaintiff can only treat the initial entry as trespass and must content himself with one action in which damages are recoverable for both past and future loss.

One of the basic heads of damages in contract and tort. Now a term of art with no precise difference between pain on the one hand and suffering on the other. It has been suggested that pain is the immediately felt effect on the nerves and brain as a consequence of some lesion or injury to part of the body, while suffering is distress that is not felt directly as being connected with any bodily condition. It includes fright at the time of injury, fear of future incapacity, possible death, insanity or inability to make a living.

CONT

Perhaps the most far-reaching change, and the one that will affect all auditors, directors and officers, is the introduction of a regime of modified proportionate liability to replace the current joint and several liability regime.... In principle, a defendant will in the future only be liable to pay damages that correspond to his or her degree of responsibility for the loss.

OBS

Under the modified proportionate liability regime in Canada, joint and several liability will continue to be applied to claims made by unsophisticated investors [individuals whose net worth is less than a threshold amount].

French

Domaine(s)
  • Droit des délits (common law)
  • Vérification (Comptabilité)
CONT
