A lease may be defined as a grant of the right to possession of the leased premises for a specified period of time commencing either immediately or at some ascertainable date in the future and ending at some point thereafter. A transaction is characterized as a lease rather than a grant when the owner or the grantor of the interest retains a "reversionary interest". In other words, possession of the leased premises reverts to the lessor on the termination of the lease. In order for the transaction to be characterized as a lease rather than a licence, the lessee's possession of the leased premises must be exclusive. A contract for a lease is an agreement enforceable in law whereby one party agrees to grant and another to take a lease. The expressions "contract for lease" and "agreement for lease" are usually interchangeable, but "contract for lease" is to be preferred as being more definite, agreement frequently meaning one of many stipulations in a contract. Normally, only assets which are legally owned by a company are recorded as fixed assets in their financial statements. Certain leases, however, are considered to be merely another means of financing the acquisition of an asset. In these cases, the lessee carries substantially all of the risks and benefits associated with property ownership.
