This duty of honesty "is a general doctrine of contract law that applies to all contracts" and consequently, parties are not free to exclude it... This means simply that parties must not lie or otherwise knowingly mislead each other about matters directly linked to the performance of the contract.... Recognizing a duty of honest performance flowing directly from the common law organizing principle of good faith is a modest, incremental step. 1, record 1, English, - duty%20of%20honest%20performance

The liability of occupiers hinges on the inveterate distinction... between activities creating risks of harm and the failure to take affirmative action to prevent harm.... the common law... was generally cool to the plea that anyone should be obliged to exert himself on behalf of another, at least in the absence of some corresponding benefit. This factor goes far to explain the erstwhile reluctance to expose occupiers to the discipline of a general duty of care....(However) the mere fact that the defendant happens to be an occupier does not mean his duties are necessarily and exclusively defined by his "occupancy" duties : they may well be augmented by a general duty of care as the result of some additional factor colouring his relationship to the plaintiff... 1, record 7, English, - general%20duty%20of%20care

"delivered duty unpaid" means that the seller delivers the goods to the buyer, not cleared for import, and not unloaded from any arriving means of transport at the named place of destination. The seller has to bear the costs and risks involved in bringing the goods thereto other than, where applicable, any "duty" (which term includes the responsibility for and the risks of the carrying out of customs formalities, and the payment of formalities, customs duties, taxes and other charges) for import in the country of destination. Such "duty" has to be borne by the buyer as well as any costs and risks caused by his failure to clear the goods for import in time. However, if the parties wish the seller to carry out customs formalities and bear the costs and risks resulting therefrom as well as some of the costs payable upon import of the goods, this should be made clear by adding explicit wording to this effect in the contract of sale. 2, record 24, English, - delivered%20duty%20unpaid

1, record 24, French, - rendu%20droits%20non%20acquitt%C3%A9s

Failure to act. The common law has treated the Good Samaritan with uncommon harshness over the years, while the priest and the Levite have been treated with uncommon generosity. One who attempts in good faith to assist someone in peril exposes himself to potential civil liability if he bungles the attempt, but one who stands idly by without lifting a finger incurs no liability, although the latter conduct is probably more reprehensible and more deserving of a civil sanction.... In short, our courts have established no general civil duty to render assistance to individuals in danger. 2, record 29, English, - failure%20to%20act

The field of occupier's liability has been complicated further by an overridding distinction between an "activity duty" and an "occupancy duty", which derives from the misfeasance-nonfeasance dichotomy. If an entrant is injured by "current operations" being carried out by the occupier on the land, as opposed to a defect or danger in the condition of the land, the courts will impose the general duty to use reasonable care. This general duty is owed to all persons lawfully on the premises, but it is unclear whether it is also applicable to trespassers whose presence is known or probable. 1, record 30, English, - activity%20duty

1, record 30, French, - devoir%20reli%C3%A9%20%C3%A0%20l%27activit%C3%A9

"delivered duty paid" means that the seller delivers the goods to the buyer, cleared for import, and not unloaded from any arriving means of transport at the named place of destination. The seller has to bear all the costs and risks involved in bringing the goods thereto including, where applicable, any "duty" (which term includes the responsibility for and the risks of the carrying out of customs formalities and the payment of formalities, customs duties, taxes and other charges) for import in the country of destination. 3, record 39, English, - delivered%20duty%20paid

delivered duty paid: Whilst the EXW term represents the minimum obligation for the seller, DDP represents the maximum obligation. This term should not be used if the seller is unable directly or indirectly to obtain the import license. However, if the parties wish to exclude from the seller’s obligations some of the costs payable upon import of the goods (such as value-added tax: VAT), this should be made clear by adding explicit wording to this effect in the contract of sale. If the parties wish the buyer to bear all risks and costs of the import, the DDU term should be used. rendu droits acquittés : Alors que le terme EXW définit l'obligation minimale du vendeur, le terme DDP en définit l'obligation maximale. Mechanical street sweepers are the "heavy duty" machines of the industry; having the capability to move the most material in the least amount of time. This general class of street sweeper utilize a system of brooms and either a "squeegee" or belt conveyor to move debris from the ground into a hopper contained within the street sweeper. A mechanical broom sweeper can pick up large chunks of debris. A mechanical broom sweeper can "dig into" and remove hard packed dirt and mud. Mechanical sweepers are very efficient when picking up wet leaves, large aggregate particles, small limbs, smashed cans, etc. Dust control for this type of machine can be a problem because of the churning action of the brooms. The onboard street sweeper water spraying system(dust control) will generally mitigate dust when working in low debris areas. 1, record 42, English, - mechanical%20street%20sweeper

In view of the ease and swiftness of modern transportation, many nations entered into extradition treaties with other countries, especially with close neighbours, to establish an over-all regulation of the mutual surrender of fugitive criminals. In some instances the enactment of general extradition laws, as well as the need for a formal international arrangement as prerequisite for extradition, has stimulated this development.... These treaties usually specify the extraditable offenses as well as other conditions for the surrender of persons accused or convicted of the commission of a crime. In most cases they establish an absolute duty to extradite, but in some instances extradition is left to the discretion of the requested state. 3, record 47, English, - treaty%20of%20extradition

It is sometimes asserted that a state may exist even though it has no territory, and in this connection instances of the governments in exile during the World War II are cited. This, however, is not a true illustration because the cases of the governments in exile are merely examples of lawful governments functioning from another country during continuance of military operations.
