DEF

The liability of occupiers hinges on the inveterate distinction... between activities creating risks of harm and the failure to take affirmative action to prevent harm.... the common law... was generally cool to the plea that anyone should be obliged to exert himself on behalf of another, at least in the absence of some corresponding benefit. This factor goes far to explain the erstwhile reluctance to expose occupiers to the discipline of a general duty of care....(However) the mere fact that the defendant happens to be an occupier does not mean his duties are necessarily and exclusively defined by his "occupancy" duties : they may well be augmented by a general duty of care as the result of some additional factor colouring his relationship to the plaintiff...

General occupancy. If the estate "pur autre vie" was merely granted "to A" without any mention of his heirs, A's heir had no special claim to the land, for it was not inheritable. The first person to enter the land after A's death was therefore entitled to it as "general occupant" for the rest of the life of the "cestui que vie"....(Megarry & Wade, 4th ed., 1975, p. 101).

CONT

The field of occupier's liability has been complicated further by an overridding distinction between an "activity duty" and an "occupancy duty", which derives from the misfeasance-nonfeasance dichotomy. If an entrant is injured by "current operations" being carried out by the occupier on the land, as opposed to a defect or danger in the condition of the land, the courts will impose the general duty to use reasonable care. This general duty is owed to all persons lawfully on the premises, but it is unclear whether it is also applicable to trespassers whose presence is known or probable.

CONT

PWGSC [Public Works and Government Services Canada] provides office space in accordance with the Framework for Office Accommodation and Accommodation Services and the PWGSC Office Accommodation Allocation Limits appended to that document. Departments can develop MOA [Master Occupancy Agreements] with PWGSC which will then take precedence over the generic standards. This document describes the 4 GRPs [Generic Requirements Packages] which PWGSC developed to act as models for the more specific tenant requirements contained in the MOA. Four office types are described in this document :-General Administrative Offices primarily accommodate administrative and related functions(e. g. a headquarters or regional office facility) ;-Public Contact Offices accommodate functions primarily involved with providing services to the public(e. g. offices serving the public by phone, mail or in-person such as Employment Centres, Passport Offices) ;-Secure Administrative Offices : require enhanced levels of security(e. g. Parole Offices of Corrections Canada) ;-Quasi-judicial Offices : are facilities designated for adjudicative or legislative functions(e. g. Citizenship Court of Canada, offices for various tribunals and boards).
