In International Law, equity may be considered a secondary source, and by Article 38(2) of the Statute of the International Court of Justice, referring to Article 38(1), «This provision shall not prejudice the power of the court to decide a case ex aequo et bono, if the parties agree thereto». Though the Court has thus not been expressly authorized to apply equity as distinguished from law, Article 38(1) c) expressly directs the application of «general principles of law recognized by civilized nations»... and in several States, as noted above, principles of equity have an established place in their municipal legal systems. No doubt the international judge can decide according to principles of equity in absence of rules of positive law, but it is doubtful whether he can decide «contra legem», i. e. contrary to such rules when they exist. 1, record 1, English, - equity

En Droit International, l'équité peut être considérée comme une source secondaire et, selon l'Article 38(2) du Statut de la Cour Internationale de Justice qui renvoie à l'Article 38(1), «la présente disposition ne porte pas atteinte à la faculté pour la Cour, si les parties sont d'accord, de statuer ex æquo et bono». Bien que la cour ne soit pas ainsi expressément autorisée à appliquer le principe d'équité, tel qu'il est conçu distinct du droit, l'Article 38(1) c) met la Cour dans l'obligation d'appliquer «les principes généraux de droit reconnus par les nations civilisées» [...] et dans plusieurs États, comme mentionné plus haut, les principes d'équité ont une place bien établie dans les systèmes de droit national.
