GENERAL PROBATE [13 records]

Record 1 2014-02-21

English

Subject field(s)
  • Law of Estates (common law)
OBS

Probate of a will in some jurisdictions requires the institution of a formal proceeding, upon notice to next of kin and others in interest, while in other jurisdictions probate is "pro forma" and notice, if any, is given after the will has been admitted to probate. The chief difference between the two kinds of probate is that in the former case(called "probate in solemn form" or "formal probate") persons who receive the required notice or appear in the proceeding must therein assert any objections they may have to the admission of the will to probate and, if they fail to do so, are, in general, precluded by the entry of a decree of probate from thereafter contesting the will or objecting to its validity; while in the latter case(called "probate in common form" or "informal probate") the will is first admitted to probate and any objections and contests may be asserted after probate.... [Tomlinson, "Administration of Decedents’ Estates, "2nd ed., 1978, p. 69].

In general an executor cannot assign his office because it is an office of personal trust. However section 7 of the "Administration of Estates Act 1925" provides for the automatic transmission of the office on death through proving executors. This important provision must now be considered. 1. Executor by representation. Say X is the sole, or last surviving, executor of a testator T. X has obtained probate of T's will. X dies, having by his will appointed Y to be his executor, and Y obtains probate of X's will. Y is the executor of X and the executor by representation of T. OBS

Where the deceased left a will, but there is no proving executor, a grant of administration "cum testamento annexo" is made. [Mellows, "The Law of Succession," 4th ed., 1983, p. 226].

CONT

If a will of the deceased exists, but no executors has been appointed, or the executor appointed predeceases the testator, or refuses or becomes incapable to act, the court will grant(as a general rule, to the person having the greatest interest under the will, e. g., the residuary legatee) letters of administration with the will annexed(cum testamento annexo), a grant which is similar to probate of the will.(Jowitt, p. 1084)

Problems of classification. The distinction between general and special powers is, however, as has been pointed out, now demonstrably inadequate in the light of judicial recognition of a number of limited or "hybrid" powers such as...(b) a consent power... CONT

The power of an executor may be limited as to the subject-matter upon which it is to be exercised... Thus it is often convenient for an author to appoint a special "literary executor" in view of the special nature of property in his works, rather than involve the general executor in the employment and supervision of literary agents over long periods.(Williams, Mortimer and Sunnucks on Executors, Administrators and Probate, 1982, p. 33)

General and limited probate. Where a testator has appointed an executor of his will generally, and another executor for particular purposes, and the general and limited executors apply for probate together, the grant is made in the same instrument, but the powers of each are distinguished; i. e., probate in respect of all the estate is granted to the general executor but the powers of the other executor are limited in the manner specified in the will.(Tristram and Coote, 26th, p. 374)

A need for a "caeterorum" grant may arise, for example, when the assignee of part of the deceased's estate has obtained a grant limited to the property he claims, or a legatee has obtained a grant limited to the amount of his legacy, or a trustee or "cestui que trust" has obtained administration limited to the property of which the deceased was trustee.
