The solution to this problem is given by article 1442 [of the Quebec Civil Code], which provides that "[t] he rights of the parties to a contract pass to their successors by particular title if the rights are accessory to the property which passes to them or are closely related to it. "In this provision, the expression "successor by particular title" means someone who obtains a specific portion of another's patrimony, be it through sale, exchange, gift or other means. Unlike succession by universal or general title, succession by particular title is not restricted to cases of death. 1, record 1, English, - successor%20by%20particular%20title

In conveyances, mortgages and many other assurances of corporeal hereditaments, numerous words descriptive, not only of every kind of easement, privilege or appurtenance, supposed to be capable of belonging to the property assured, but also of portions of the soil, fixtures and produce of the land(as timber) were, prior to the "Conveyancing Act, "1881, added to the parcels or description of the property, and were called the "general words. "They were useful when there were any easements or privileges reputed to belong to the property, although not legally appurtenant to it, as they would not have passed with the property unless expressly mentioned. This phrase is a general denomination of personal property, as distinguished from real property. In the law of wills, the term "goods and chattels" will, unless restrained by the context, pass all the personal estate.(Black's, 5th ed., 1979, p. 624). 1, record 27, English, - goods%20and%20chattels

"Goods and chattels," at the time when these words were introduced into English law, were used to embrace all property not included in "lands, tenements and hereditaments" which are technically descriptive of realty. As such, the expression "goods and chattels" is used as equivalent to "personalty," but in the interpretation of dispositions and of statutes, this must not always be accepted. The term "title" has been described as the means whereby the owner of lands has the just possession of his property. It is often used as a synonym for ownership and, in general, this terminology causes little difficulty. However, it should be remembered that the common law did not recognize allodial title, that is to say, ownership of the land. Rather it recognized tenurial title, which means ownership of an estate in land held either directly or indirectly from the Crown. Hence, it is more accurate to say that "title" connotes the lawful right of possession of an estate in land.(Anger and Honsberger, 2nd, p. 1258) 1, record 35, English, - title

The concept of limitation must be contrasted with the concept of prescription. The former was unknown to the common law and is wholly a creature of statute. The latter was a common law rule of evidence based on the presumption of lost modern grant. The former abolishes stale or obsolete claims and operates in a negative fashion. The latter creates or establishes rights in land such as easements and operates in a positive fashion. (Anger & Honsberger, 2nd ed., 1985, p. 1496). 1, record 45, English, - limitation
Record number: 45, Textual support number: 2 OBS
Statutes of Limitation are generally regarded as a means of protecting the defendant against a stale or unjust claim. Except in actions chiefly concerned with real property, in which, by the judicial interpretation of the limitation provisions applicable thereto, it has been held that the lapse of the statutory period operates to extinguish the right, "The Limitations Act" operates merely as a bar to the remedy by proceedings in the courts. Except where the statute by its terms absolutely extinguishes the debt or demand itself, the general rule with respect to debts, or more money demands is that statutes of limitation are regarded as barring the remedy, and not as extinguishing the cause of action.("C. The general principle with which construction commences is that all words importing futurity, whether conditional or merely temporal, make a gift "prima facie" contingent. Thus, where property is given to a person "if", or "provided that", a specified event occurs, the gift will be contingent, but it will also be contingent if words such as "at", or "upon" the occurrence of the event, or "when", "as", or "from and after" its occurrence are used. Hence, a gift "to A when he shall attain the age of 25 years", is "prima facie" contingent.(Anger & Honsberger, 2nd ed., 1985, p. 364) 1, record 53, English, - contingent%20gift

The term antistatic refers to a condition where static generation is inhibited during contact and separation with a different material. In general, antistatic carpet is any carpet product that will generate less static electricity than standard carpet. [It] is not conductive and it is not possible to ground anti-static carpet [which] usually contains bi-component yarns. The reason for specifying antistatic carpet is to establish a space that will be free of static shocks, or zaps. Most new antistatic carpet will prevent shocks as long as the relative humidity(RH) is above 25%. Antistatic carpet should not be confused with conductive or ESD [electrostatic discharge] carpet.
