In International Law, equity may be considered a secondary source, and by Article 38(2) of the Statute of the International Court of Justice, referring to Article 38(1), «This provision shall not prejudice the power of the court to decide a case ex aequo et bono, if the parties agree thereto». Though the Court has thus not been expressly authorized to apply equity as distinguished from law, Article 38(1) c) expressly directs the application of «general principles of law recognized by civilized nations»... and in several States, as noted above, principles of equity have an established place in their municipal legal systems. The general thrust of the new ICAO draft is to establish a threshold of 60 minutes’ flying time at single-engine speed from an alternate, beyond which twins may not operate unless they have demonstrated a certain standard of powerplant reliability and systems redundancy. Existing rules date from the late 1940s and are recognised to be outmoded in the light of current technology.
