1, record 5, French, - acte%20formaliste

The word, heirs, is necessary in the grant or donation in order to make a fee, or inheritance. For if land be given to a man for ever, or to him and his assigns for ever, this vests in him but an estate for life.... [This rule] does not extend to devises by will; in which, as they were introduced at the time when the feodal rigor was apace wearing out, a more liberal construction is allowed : and therefore by a devise to a man for ever, or to one and his assigns for ever, or to one in fee-simple, the devisee hath an estate of inheritance; for the intention of the devisor is sufficiently plain from the words of perpetuity annexed, though be hath omitted the legal words of inheritance. But if the devise be to a man and his assigns, without annexing words of perpetuity, there the devisee shall take only an estate for life; for it does not appear the devisor intended any more....(Blackstone, Book II, p. 107-108) 1, record 6, English, - words%20of%20perpetuity

By happy contrast, dealing fully with words of grant requires less than a page. There are but three points worth mentioning. First, what verb should be used in a conveyance to pass an estate or interest in land? The answer is : any verb you like. Section 51(2) of the "Law of Property Act" 1925 provides that :’The use of the word grant is not necessary to convey land or to create any interest therein. ’Thus any appropriate word may be used, such as the customary "conveys" in a conveyance or, for example, "assents" in an assent.(Farrand, 3rd ed., 1980, pp. 272-273). 1, record 8, English, - words%20of%20grant

There are certain cases in which there is said to be a tenancy by estoppel. If a person with no estate in land purports to grant a tenancy of the land, the grant can pass no actual estate. Yet, even though the lessor's want of title is apparent to the parties, both the parties and their successors in title will be estopped from denying that the grant was effective to create the tenancy that it purported to create(Megarry and Wade, p. 646). 1, record 9, English, - tenancy%20by%20estoppel

While there is difference of opinion as to what constitutes privity of estate in relationships outside of that of landlord and tenant, the weight of authority is to the effect that there is privity of estate when the fact of succession is found to have taken place between covenantor and covenantee, as in a grant of an estate in land made by one of the parties to the other. The modern rule seems to be that either mutuality or succession of interrelationship to the same rights of property creates that privity of estate necessary to enable a covenant to run with the land.(Cartwright, 1972, p. 729). 1, record 18, English, - privity%20of%20estate

[Natural right of property] is an expression often used to describe a right that is one of the ordinary and inseparable incidents of ownership, though its exercise requires an adjacent owner to forbear from doing something on his own land that otherwise he would be free to do. Statutes of Limitation are generally regarded as a means of protecting the defendant against a stale or unjust claim. Except in actions chiefly concerned with real property, in which, by the judicial interpretation of the limitation provisions applicable thereto, it has been held that the lapse of the statutory period operates to extinguish the right, "The Limitations Act" operates merely as a bar to the remedy by proceedings in the courts. Except where the statute by its terms absolutely extinguishes the debt or demand itself, the general rule with respect to debts, or more money demands is that statutes of limitation are regarded as barring the remedy, and not as extinguishing the cause of action. Common of pasture appurtenant is a right annexed to certain lands, by virtue of which the owner of those lands feeds cattle on the soil of another person; it differs from the right of common appendant in all the characteristics which arise from the connection of the latter with the socage tenure of ancient arable land in a manor; it may, therefore, be held by holders of estates formerly copyhold or by strangers to a manor, and may arise by grant or prescription since "Quia Emptores", 1289, and is not necessarily confined to such beasts as are generally commonable but may extend to swine, goats or geese.(Jowitt's, 2nd ed., 1977, p. 387) 1, record 35, English, - common%20of%20pasture%20appurtenant

A contract for a lease is an agreement enforceable in law whereby one party agrees to grant and another to take a lease. The expressions "contract for lease" and "agreement for lease" are usually interchangeable, but "contract for lease" is to be preferred as being more definite, agreement frequently meaning one of many stipulations in a contract. A contract for a lease is to be distinguished from a lease, because a lease is actually a conveyance of an estate in land, whereas a contract for a lease is merely an agreement that such a conveyance shall be entered into at a future date.(Woodfall, 27th, p. 132) 1, record 38, English, - contract%20for%20lease

Prior to("Quia Emptores") the number of subtenures had greatly increased by the process of subinfeudation. By this process a tenant, instead of alienating his land outright for a capital sum, created a new tenurial relationship between himself and another whereby the other person became his tenant of the land in return for a perpetual grant or service. The new tenant might create a further subtenure and in theory the process could go on "ad infinitum". "Quia Emptores" accomplished two important objectives. In the first place it abolished alienation by subinfeudation and secondly, it endorsed the principle of alienation by substitution.(Anger & Honsberger, 2nd ed., 1985, p. 23) 1, record 40, English, - alienation%20by%20subinfeudation

6, record 44, French, - sp%C3%A9culation%20fonci%C3%A8re

A state may grant a right of exclusive use over a part of its territory to another state, retaining sovereignty, but conceding the enjoyment of the liberties of the territorial sovereign. Such a grant may be described as a "lease"... these grants do constitute privileges, and in principle their incidence depends on the consent of the territorial sovereign. In most cases where military and naval bases have been established by agreement the result is more akin to a contractual licence than it is to an interest in land in the English sense. 1, record 49, English, - lease
