licence: A right or permission granted in accordance with law by a competent authority to engage in some business or occupation, to do some act, or to engage in some transaction which but for such license would be unlawful ...

OBS

permit : A written licence or warrant, issued by a person in authority, empowering the grantee to do some act not forbidden by law, but not allowable without such authority. The term "permit" is often confused with "licence, "but important differences exist between the two.... In a few dictionaries, however, "permit" is given as a synonym of "licence" or as a type of licence. Thus, although "permit" is usually translated as "permis" the context may require the French term "licence. "

He who, after his ancestor dies intestate, has a right to all lands, tenements, and hereditaments which belonged to him or of which he was seised. The same as "heir general" ... [Black’s, 5th ed., 1979, p. 854].

CONT

The feudal rules of succession applied to find the heir were based on the succession of males in preference to females, on primogeniture among males, and on representation, whereby a descendant of a pre-deceased heir, e.g. a grandson, took in preference to a collateral of the deceased, e.g. a brother. An heir general or heir at law is such an heir. [The "Oxford Companion to Law," 1980, p. 559].

CONT

The reason why words of procreation were required was that "heirs, "extended to all the "heirs general, "including relatives other than descendants of the grantee, such as his brothers, uncles or cousins. An entail, however, was an interest which could pass only to lineal descendants of the original grantee(heirs special) and so "heirs" had to be restricted by the addition of words of procreation. Words of inheritance are words of limitation indicating the character of the estate granted (or devised) ... Many jurisdictions have done away with the necessity of using technical words limiting estates in land, to the end that a fee estate may be created without words of inheritance. (Cartwright, 1972, p. 1017).

CONT

Exactly why the words "and his heirs" where necessary to create an estate in fee simple is unclear.... was, however, necessary to use the plural word ’heirs" because if the grant were to a person and his "heir", that word could refer only to the person who would be the heir at the death of the grantee, so as not to be a word of inheritance or limitation. In such a case, at common law, the grantee would get only a life estate.(Anger and Honsberger, 2nd ed., 1985, pp. 101-102).

There are two ways that a searcher can circumvent this tedious process of using the Grantee indexes to "go back" on a title. Another lawyer can let him borrow his title abstract... The other method is the use of "tie-in clauses". For example, assume that at the end of the legal description in a 1984 deed from G. H. to I. J., the conveyancer who prepared the deed were to add a clause to the following effect : Being the same lands described in a deed from E. F. to G. H. dated Jan. 7, 1972 and recorded at(Halifax) Registry of Deeds office on Jan. 7, 1972 in Book 2529 at page 47. The searcher wouldn’t waste time searching the Grantee index, starting in 1984-he’d immediately open Book 2529 to page 47 and examine the deed to G. H.(Howlett, 1986, p. 5).

When a person has an interest in lands, and grants a portion of that interest, the possession of the lands, on the determination of the interest granted, returns or reverts to the grantor. This interest is what is called the grantor’s reversion, or, more propertly, his right of reverter. (Jowitt, p. 1575)

OBS

In feudal times, on every grant of land, a right remained in the grantor to the services of the grantee during the continuance of his estate, and to a return of the land on its expiration. Whether this right of the grantor depended on an estate for life or in fee, it was of the same nature and was called his reverter or escheat;(Jowitt's, 2nd ed., 1977, p. 1577).

An option may be described as a right usually acquired by contract to accept or reject a continuing offer within a prescribed period. When supported by consideration it constitutes an irrevocable offer binding on the grantor of the option. The person in whose favour it is made, the grantee, assumes no obligations. An option to purchase land, for instance, is not a contract for the sale and purchase of land. Under the latter one party is bound to sell and the other is bound to buy, whereas an option simply gives the grantee a right to purchase without any obligation to do so.(Barnsley, p. 1)

The memorial is an abstract of the material parts of the deed, with the parcels at full length, and concludes with a statement that the party desires the deed to be registered. The execution of the deed and memorial is proved by the oath of an attesting witness. (Jowitt, 2nd ed., 1977, p. 1171).

Under the grantor-grantee or alphabetical index, pages are assigned in the index to each letter of the alphabet. As an instrument is received at the recorder's office, it is first recorded and then indexed under the name of the granting party on the appropriate page of the index. In addition, the county recorder is usually required to make notations on the grantor's page which disclose the name of the other party to the transaction, the book and page of the record where this particular transaction can be found, a description of the property, the date when the instrument was executed, the date when the instrument was filed for recordation, and the nature of the instrument. These same notations are then made as the transaction is indexed under the name of the grantee or the receiving party. After both steps have been completed, the instrument is considered to have been properly indexed.(Axelrod, Berger and Johnstone, 1971, p. 551).

Delivery may be absolute or conditional and if the latter, it will be said to be delivery "in escrow" if the deed is to be held by someone not a party to it until some condition is performed by the party to be benefitted by the deed and upon fulfilment to take effect. (Lamont, "Real Estate Conveyancing", 1976, p. 85).

CONT

Under the old law, a deed could not be delivered, as an escrow, direct to the grantee. Delivery in escrow was made to a third party-the first delivery-and, upon the fulfilment of the condition, the third party would deliver the deed to the grantee-the second delivery. It seems that the old law no longer applies. The more modern approach is to treat the question as one of fact; even where there is delivery to the grantee, the intention of the parties must be ascertained, from the transaction as a whole, as to whether the delivery was absolute or conditional.(Mendes da Costa and Balfour, p. 401)

If a deed be made by more parties than one, there ought to be regularly as many copies of it as there are parties, and each should be cut or indented (formerly in acute angles "instar dentium," like the teeth of a saw, but at present in a waving line) on the top or side, to tally or correspond with the other; which deed so made, is called an indenture. (Blackstone, 15th ed., 1809, Book II, c. 20, p. 295)

CONT

In modern practice the indenture as well as the deed poll is written on a single sheet of paper, the indenture not being "indented" as anciently; the difference between the two being that the indenture is signed by both grantor and grantee, the deed poll being signed only by the grantor.(Cartwright, 1972, p. 251)
