A testamentary trust is created in accordance with the instructions in a person's last will and testament and outlines when assets will be given to certain named beneficiaries. Unlike a living trust, a testamentary trust goes into effect after one's death. The testamentary trust definition outlines three main parties : a grantor, a trustee, and the beneficiary. The grantor, or person creating the trust, appoints the trustee to manage assets before they are ultimately given to the beneficiary. 2, record 2, English, - testamentary%20trust

An option may be described as a right usually acquired by contract to accept or reject a continuing offer within a prescribed period. When supported by consideration it constitutes an irrevocable offer binding on the grantor of the option. The person in whose favour it is made, the grantee, assumes no obligations. An option to purchase land, for instance, is not a contract for the sale and purchase of land. Under the latter one party is bound to sell and the other is bound to buy, whereas an option simply gives the grantee a right to purchase without any obligation to do so.(Barnsley, p. 1) 1, record 43, English, - option

The memorial is an abstract of the material parts of the deed, with the parcels at full length, and concludes with a statement that the party desires the deed to be registered. To this point, the words ’enrollment’, ’registration’, and ’recording’ have been used interchangeably. The "Statute of Enrollments" required enrollment, and the "Middlesex Act" required registration. Both of these procedures are the same and are satisfied by a memorandum or memorial included in the public records stating the names of the grantor and of the grantee of the instrument, and the interest purportedly transferred. Recording requires that a complete copy of the instrument be included in the public records.(Mapp, 1978, p. 48). 1, record 46, English, - memorial

A lease may be defined as a grant of the right to possession of the leased premises for a specified period of time commencing either immediately or at some ascertainable date in the future and ending at some point thereafter. A transaction is characterized as a lease rather than a grant when the owner or the grantor of the interest retains a "reversionary interest". In other words, possession of the leased premises reverts to the lessor on the termination of the lease. In order for the transaction to be characterized as a lease rather than a licence, the lessee's possession of the leased premises must be exclusive. If ultimate possession and control remain with the lessor, a licence rather than a lease will exist....("Real Estate and Landlord and Tenant", 1983-1984, p. 334) 1, record 51, English, - lease

The Statute of "Quia Emptores" abolished rent service arising upon a conveyance in fee simple, by prohibiting subinfeudations. A ground rent in its pure form is a rent reserved to himself and his heirs by the grantor of a freehold estate in land, out of the land itself. It is not granted like an annuity or a rent charge, but is reserved out of a conveyance of the land in fee. It is a separate and distinct estate in itself and is held to be real estate with the usual characteristics of an estate in fee simple. The holder of a ground rent proper has an estate in the land itself, for the ground rent is a rent service and the grantor has a reversion. The right of distress is an incident of ground rent proper.(Cartwright, 1972, p. 805) 1, record 55, English, - ground%20rent

Down to 1881 it was customary to insert in every conveyance after the grant of the parcels and the general words the following words :"And all the estate right title interest claim and demands of the grantor unto and upon the said premises. "Even before 1881 these words-known as the "estate clause, "or "all estate clause"-had no effect in law : nothing passed under them which would not pass without them; and now they are omitted in reliance on the "Law of Property Act", 1925,... which enacts that every conveyance shall pass all the estate, right, title, interest, claim and demand of the grantor unless a contrary intention is expressed.(Jowitt, 2nd ed., 1977, p. 725). 1, record 79, English, - estate%20clause
