When the landowner defaulted, courts of equity were again asked to respond, and developed the system of equitable foreclosure. The landowner's failure to repay the loan no longer resulted in an automatic forfeiture of their ownership interest in the land to the lender. Instead, the lender would have a right to petition a court for a decree of foreclosure, the granting of which would bar the landowner's right to the equity of redemption. The lender would thereby recoup his investment by taking title and possession of the property if the landowner failed to repay the loan within a time fixed by the court. The equitable foreclosure system was slow but fair : the lender could petition the court to give ownership of the land to the lender to repay the loan, but the landowner would have a chance to remedy the default or explain the default when the lender had not behaved reasonably. 2, record 2, English, - equitable%20foreclosure

When you take out a mortgage on a home, you’ll generally have your regular payment automatically deducted from your account, to cover the entire amount. This can be deceiving, since your mortgage payment may consist of several components : the mortgage principal and interest, property taxes and mortgage life insurance. Let's take them one at a time.... Mortgage interest. Generally, mortgage interest costs are front-loaded, so that that interest comprises a much larger percentage of your regular mortgage payment at the beginning of the life of the mortgage than toward the end. 2, record 3, English, - mortgage%20interest

An easement is an interest in land in the possession of another. It is not, itself, a possessory interest. The fact that the owner of an easement is not deemed to have a possessory interest in the land with respect to which it exists indicates a lesser degree of control of the land than is normally had by persons who do have possessory interests.("Restatement of the Law of Property", p. 2903). 1, record 10, English, - possessory%20interest

A person has a consummate or complete property in the thing land when he may enforce all of the demands the particular system of law under which he lives at a particular time allows him to make with respect to the land in which he claims an interest, and to the extent he so lawfully claims. The Department of Housing and Municipal Affairs is responsible for the Personal Property Registry(PPR) which is a centralized computer registry service that extends throughout the entire province of Nova Scotia. The PPR allows both individuals and organizations to record their financial interest in personal property(cars, boats, appliances, etc.). For example, if you have a car loan with a financial institution, that car is the security for your loan. Until you have repaid the loan, the institution has a financial interest in that car. The PPR is the place to record that interest and make that information available to other interested individuals and organizations. 1, record 21, English, - Personal%20Property%20Registry
