In International Law, equity may be considered a secondary source, and by Article 38(2) of the Statute of the International Court of Justice, referring to Article 38(1), «This provision shall not prejudice the power of the court to decide a case ex aequo et bono, if the parties agree thereto». Though the Court has thus not been expressly authorized to apply equity as distinguished from law, Article 38(1) c) expressly directs the application of «general principles of law recognized by civilized nations»... and in several States, as noted above, principles of equity have an established place in their municipal legal systems. No doubt the international judge can decide according to principles of equity in absence of rules of positive law, but it is doubtful whether he can decide «contra legem», i. e. contrary to such rules when they exist. 1, record 3, English, - equity

In a practical sense, sovereignty is also largely a matter of degree. Some States enjoy more power and independence than other States.
