The classical pronouncement of a general formula for "duty" is Lord Atkin's... "neighbour test" in Donoghue v. Stevenson :... You must take reasonable care to avoid acts or omissions which you can reasonably foresee would be likely to injure your neighbour. Who then, in law, is my neighbour? The answer seems to be-persons who are so closely and directly affected by my act that I ought reasonably to have them in contemplation as being so affected when I am directing my mind to the acts or omissions which are called in question. 2, record 16, English, - neighbour

In addition to the terms which the parties have expressly adopted, there may be other terms imported into the contract, these latter being generally known as implied terms, though this nomenclature is misleading in that it covers a number of dissimilar notions. As a general rule, the courts will enforce not only the terms expressly agreed between the parties, but also those which are to be logically implied from those express terms.... Even where a term may not be logically implied from the words used, the law admits of certain other terms to be implied as follows :(1) terms which the parties probably had in mind but did not express;(2) terms which the parties, whether or not they actually had them in mind, would probably have expressed if the question had been brought to their attention; and(3) terms that, whether or not the parties had them in mind or would have expressed them if they had foreseen the difficulty, are implied rules of law.(9 Hals., 4th ed., p. 224) 1, record 24, English, - implied%20term

Mono means that there's only one output signal. There could be more than one speaker but each speaker will have the same output. 1, record 53, French, - Programme%20de%20traitement%20pour%20jeunes

Since the enactment of the Canadian Charter of Rights and Freedoms in 1982 there have been many cases in which courts in Canada at all levels excepting the Supreme Court of Canada have expressed views on the meaning of "bringing the administration of justice into disrepute" within the meaning of s. 24(2) of the Charter. The most helpful views are contained in several cases extensively reviewed by Coleman, J., in Lysohirka et al.... and start with the comment of Lamer, J. A., in Rothman...(Pre-Charter) wherein he comments at page 152 :... "The judge, in determining whether under the circumstances the use of the statement in the proceedings would bring the administration of justice into disrepute, should consider all of the circumstances of the proceedings, the manner in which the statement was obtained, the degree to which there was a breach of social values, the seriousness of the charge and the effect the exclusion would have on the result of the proceedings. It must also be borne in mind that the investigation of crime and the detection of criminals is not a game to be governed by the Marquess of Queensbury rules. The authorities, in dealing with shrewd and often sophisticated criminals, must sometimes of necessity resort to tricks or other forms of deceit, and should not through the rule be hampered in their work. What should be repressed vigorously is conduct on their part that shocks the community". These comments are now often referred to as the "community shock" test.... 3, record 59, English, - community%20shock%20test

"Psychophagi"(Castler's term) are hardly ever encountered among them. Feeling the beginnings of osmosis, which may come about as the result of purely accidental approaches and fluctuations-feeling this threat in a manner that is of course nonphysical, much as someone might sense another's presence or even hear "strange voices" in his own mind-the personoids execute active avoidance maneuvers; they withdraw and go their separate ways. It is on account of this phenomenon that they have come to know the meaning of the concepts of "good" and "evil. "To them it is evident that "evil" lies in the destruction of another, and "good" in another's deliverance. At the same time, the "evil" of one may be the "good"(i. e., the gain, now in the nonethical sense) of another, who would become a "psychophage. " 1, record 61, English, - psychophage

1, record 61, French, - %C3%A2mophage

This concept serves as a summary of the decision-making process. It consists of taking into consideration the most desirable, long-term goals, setting up means-end staircases for achieving those goals, examining the steps on the staircase to discover missing or weak steps, creating ideas for new and better alternatives for those weak or missing steps, and choosing the best alternatives after uncovering most of the premises, both factual and value, germane to each, and testing these premises for reliability(validity), then weighting them. To be as rational as possible, a man would have to take into consideration all the goals, all the alternatives, and all the premises germane to those alternatives and goals-all, that is, that he could encompass within the time he has available to made up his mind. 1, record 67, English, - rationality
