When the landowner defaulted, courts of equity were again asked to respond, and developed the system of equitable foreclosure. The landowner's failure to repay the loan no longer resulted in an automatic forfeiture of their ownership interest in the land to the lender. Instead, the lender would have a right to petition a court for a decree of foreclosure, the granting of which would bar the landowner's right to the equity of redemption. The lender would thereby recoup his investment by taking title and possession of the property if the landowner failed to repay the loan within a time fixed by the court. The equitable foreclosure system was slow but fair : the lender could petition the court to give ownership of the land to the lender to repay the loan, but the landowner would have a chance to remedy the default or explain the default when the lender had not behaved reasonably.

Whether the seller is alleged to have the appearance of an agent or an owner, the cases show that something more than mere possession of the goods in question is required before estoppel can be pleaded. It is necessary for the seller to be armed with some "indicia" which made it appear that he was either the owner or had the right to sell. The mere handing over of a chattel to another does not create an estoppel. There will be no estoppel unless the doctrine of ostensible ownership applies, for example, when the owner gives the recipient a document of title, or, invests him with the "indicia" of ownership.(Fridman, "Sale of Goods", p. 133-134)

CONT

... the TSB [Transportation Safety Board of Canada] analyzed specifically the aircraft steering system, while not ignoring the other factors mentioned above, although no indication was found that they could have contributed to the occurrence. To steer the aircraft on the ground, the pilot in the left seat uses the nose-gear steering wheel on the console to the pilot's left. During take-off and landing, directional control of the aircraft is maintained solely by the rudder. The aircraft's ground steering system comprises several components, including the nose-gear steering wheel, a system of cables and pulleys, and a steering control valve fitted to a nose-wheel steering cylinder, which is attached to the nose-wheel strut. The cable and pulley system links the steering wheel to the control valve. When the pilot turns the steering wheel to the left or right, tension is applied to the cables connected to the pulley on the steering control valve. This action determines the direction and the deflection rate of the nose wheel by allowing hydraulic fluid to enter one side or the other side of the nose-wheel steering cylinder; the steering cylinder then deflects the nose wheel through a system of gears.

Not just simple responses to an external stimulus play a role in instinctive behavior; instinctive activity involves sequences of behavior that run a predictable course. These behaviors may last seconds, minutes, hours or even days. Exemplifying this, we can refer to a particular species of digger wasp, which finds and captures only honeybees. With no previous experience, a female wasp will unearth an intricate burrow, find a bee, paralyze it with a careful and precise sting to the neck, pilot back to her discreet home, and, when the larder has been supplied with the correct number of bees, lay an egg on one of them and seal the chamber.... Overall, one of the main distinctive features of instinctive activity is the ability to react to an external stimulus the correct way the first chance(and every time thereafter) the animal receives. This feature distinguishes this particular behavior from what ethnologists call learned behavior, which scientists have discovered are actions that take place from conditioning an animal to learn the right way.

CONT

According to the Commissioner, the present Education Act and the system it creates do not comply with section 23 of the Charter. The problem does not lie with the existing three-tier administrative structure(school advisory committees, district committees and provincial board), but rather with the fact that, on two of these levels, parent representation is only indirect, while on all levels parents or their representatives have no exclusive right of governance affecting the minority language and culture.

However, the revolution in training, while it takes advantage of the training technologies coming forward, is no more about training than architecture is about hammers. Training technology is the tool that allows you to build the system that you like. And we have wonderful technology that is emerging to help us train. The real issue is how do you create a system that will constantly reinvent itself, so as new technology becomes available, you take advantage of it at the right places, and allow it to contribute to operational performance and excellence. This is not a revolution about hardware, it's a revolution about people.

Frequently treaties of cession have granted the inhabitants of the ceded territory to opt for one or other of the nationalities concerned. Such a right of option would seem to be part of the English law of nationality but there is no customary rule of international law in favour of option.... the Convention on the Reduction of Statelessness 1961 requires States, in the event of ceding territory, to make provision that no person shall become stateless as a result, and for cessinary States to confer their nationality on such persons as would become stateless.

Mirror symmetry, that is, invariance against "flipping sides", is perhaps the most widely noticed symmetry. Nature built many of her organisms in nearly symmetric ways, and most fundamental laws of physics, such as Newton's law of gravitation, have an exact mirror symmetry : there is no difference between left and right in the attraction of heavenly(and most earthbound) bodies. However, the nonconservation of parity in radioactive decay-that is, the violation of point symmetry in the "weak" interactions-has finally taught even the physicists to take the distinction between right and left seriously.
