A relationship in which one person is under a duty to act for the benefit of the other on matters within the scope of the relationship.

... the consent agreement is premised on a special relationship of trust often called a "fiduciary" relationship. This means that the care-giver is expected to act in a way that benefits the patient, resident or client. The trustee of an incompetent person is in a similar position. The care-giver, like the trustee, must act with a view towards what will best serve the other party in the relationship.

Interdicted persons are also incapable of contracting. The interdiction is a legal procedure whereby a court declares a person to be incompetent to exercise his rights and entrusts his assets to the care of a curator and, for certain types of interdiction, the very person of the incompetent is also entrusted to his curator.
