Formerly, if there was a scintilla of evidence to support the issues, the judge was bound to leave it to the jury; but now, in every case, it is for the judge to decide whether there is any evidence from which the jury can reasonably find for the party on whom the burden of proof rests. It there is no evidence or a mere scintilla, it is his duty to withdraw the case from the jury and enter judgment for the opposite party. And the test whether evidence only amounts to a scintilla is to assume it uncontradicted, and then inquire whether the jury would be justified in founding a verdict thereon. Scintilla of evidence has been defined as "any material evidence that if true would trend to establish the issue in the mind of a reasonable juror. "Other views are that a scintilla of evidence is no evidence or but a spark, gleam, or mere conjecture as distinguished from a reasonable inference. The expression "mere scintilla" of evidence means the least particle of evidence-evidence which, without further evidence, is a mere trifle. "More than a scintilla" may be defined as evidence of probative value having the fitness to induce conviction in the minds of reasonable men.(Corpus juris secundum, 1981, vol. 32A, p. 628) 1, record 13, English, - scintilla%20of%20evidence

Paleoclimate studies using AMS [Accelerator Mass Spectrometry] radiocarbon ... During the past several years, AMS measurements have increasingly supplanted the traditional counting method of dating since they offer greatly increased sensitivity (sub-milligram samples can be dated) and, in many instances, greater accuracy; they are also very much faster. However, the typical "bulk carbon" sample preparation techniques used for both AMS and ... counting leave unanswered the question of just what is being dated, a grave disadvantage in palynological and other paleoclimate studies. In contrast, the extraction procedures that have been developed here typically produce purified pollen samples which can be clearly identified under the microscope; thus, an unambiguous proxy climate indicator -pollen- is dated, and nothing else. 2, record 25, English, - proxy%20climate%20indicator

Pour ce faire, il peut demander à l'employé s'il sait que son travail comporte une telle vérification, constater la présence des initiales de l'employé et revérifier le calcul. Since 1978, the Oceanic Flux Program(OFP) time-series sediment traps have continuously measured particle fluxes in the deep Sargasso Sea. The OFP program is by far the longest time-series of its kind, and has produced a unique record of temporal variability in the "biological pump". Results provided the first direct evidence for the existence of seasonality in the deep ocean, and evidence that fluxes of both biogenic and abiogenic materials to the deep ocean were directly linked to seasonal patterns in upper ocean productivity. The time-series particle flux record has documented significant interannual and longer timescale variability in material fluxes to the deep ocean, and in the composition of the sinking material. The record is now becoming long enough to identify and study longer-term periodicities and quasi-decadal trends in material fluxes to the deep ocean, and their coherence with North Atlantic climate variations. The Oceanic Flux Program provides new insights into interannual variability and decadal scale changes in ocean functioning. This information is of paramount importance for predicting future, possibly anthropogenically induced, climate changes.
