When people in a dispute cannot resolve the dispute themselves, either through face-to-face negotiation or with the assistance of a mediator, they can agree to refer the matter to arbitration. In arbitration, a neutral person or panel of people hears the facts an dissues and makes a decision. Arbitrators are often people who are experts in a specific area of the law or a particular industry, especially in cases where the decision-maker needs to be knowledgeable about a particular subject matter or business practice. 5, record 4, English, - arbitrator

Jus in bello, also referred to as international humanitarian law(IHL), applies to all warring parties irrespective of the reasons for the conflict. It does not speak to whether or not the cause of war is just. Instead, this body of law seeks to protect war victims and their fundamental rights, no matter to which party they belong. 4, record 5, English, - international%20humanitarian%20law
Record number: 5, Textual support number: 2 CONT
Necessity and proportionality have always been core principles of both branches of the jus belli principles that apply to both the authority to employ military force and the regulation of actual employment. However, in the jus ad bellum context, they have never before been viewed as principles to regulate operational and tactical execution. Instead, in that context they frame the legality of national or multinational resort to military force in self-defense. Once the decision is made to employ force pursuant to this authority, the jus in bello variant of these principles (necessity of the mission and proportionality of collateral damage) operate to regulate the application of combat power during mission execution (in other words, they provide the foundation for the regulation of the application of combat power in the context of the self-defense-justified mission). 5, record 5, English, - international%20humanitarian%20law

Reasonable expectation of privacy-Section 8 of the Canadian Charter of Rights and Freedoms provides protection against unreasonable searches and seizures. The Supreme Court of Canada has defined as a "search" any state action that engages a reasonable expectation of privacy. The concept of a "reasonable expectation of privacy" is therefore employed to determine whether, as a threshold matter, the protections of Section 8 are engaged. The degree of this privacy expectation is then used in the balancing exercise to determine whether a law authorizing a search is reasonable – i. e. whether it is justifiable in light of the state's objective, taking into account any safeguards provided for in the law. 2, record 7, English, - reasonable%20expectation%20of%20privacy

Under the PPSA, the general rule is that the first creditor to register or take possession has priority. This rule is different from the rule that applies under the existing law. Currently, if a company created two charges in favour of two separate creditors, it is the creditor whose charge was created first that takes priority(so long as that creditor has registered within the 30-day period required by the Companies Act). The general rule under the PPSA is that first to register or take possession takes priority no matter which charge is signed first. One consequence is that creditors, such as banks, are likely to require registration of a financing statement as a condition precedent to advancing funds to a debtor. 2, record 20, English, - first%20creditor

What is neutron radiography? Neutron transmission radiography(NR) is based on the application of the universal law of attenuation of radiation passing through matter. The basic experimental set-up is given by the following arrangement : source-collimator-object-collector. 3, record 34, English, - neutron%20radiography

Apart from the law-making process by which it was produced, the success of the Vienna Convention [on Diplomatic Relations] depended on two factors. Perhaps the more important is that at all times the real sanction of diplomatic law is reciprocity. Every State is both a sending and a receiving State. Its own representatives abroad are hostages and even on minor matters their treatment will depend on what the sending State itself accords ... The second factor, to some extent the result of the first, was the very long stability of the rules of law being codified. By the time these rules were described by Vattel in Le Droit des Gens, published in 1958, they had developed as far as they ever did without the assistance of international agreements, and they remained constant thereafter. 2, record 54, English, - diplomatic%20law

"Canadian maritime law" as defined in s 2 of the Federal Court Act is a comprehensive body of federal law dealing with all claims in respect of maritime and admiralty matters. The scope of Canadian maritime law is not limited by the scope of English admiralty law at the time of its adoption into Canadian law in 1934. Rather, the word "maritime" is to be interpreted within the modern context of commerce and shipping, and the ambit of Canadian maritime law should be considered limited only by the constitutional division of powers in the Constitution Act, 1867. The test for determining whether a subject matter under consideration is within maritime law requires a finding that the subject matter is so integrally connected to maritime matters as to be legitimate Canadian maritime law within federal competence 2, record 55, English, - Canadian%20maritime%20law

2, record 55, French, - droit%20maritime%20canadien

Smoke Measurement ... It has been known for many years that the tar yield of any brand of cigarette does not necessarily correspond with the tar delivery of that cigarette to a human smoker. As the Fourth Report of the ISCSH observed: "These parameters have been criticised as not reflecting average human behaviour and leading to published yields universally under-estimating yields actually obtained by the average smoker. Critics of the machine smoking procedure have frequently failed to understand that values presented in tables published by DHSS have never been intended to be actual yields obtained by any one smoker. Satisfaction may be defined as any measure which the author of a breach of duty is bound to take under customary law or under an agreement by the parties to a dispute, a part from restitution or compensation. Satisfaction is an aspect of reparation in the broad sense. However, it is not easy to distinguish between pecuniary satisfaction and compensation in the case of breaches of duty not resulting in death, personal injuries, or damage to or loss of property. Claims of this sort are commonly expressed as a claim for an "indemnity". If there is a distinction, it would seem to be in the intention behind the demand. If it is predominantly that of seeking a token of regret and acknowledgment of wrongdoing then it is a matter of satisfaction. The objects of satisfaction are three, which are often cumulative; apologies or other acknowledgment of wrongdoing by means of a salute to the flag or payment of an indemnity; the punishment of the individuals concerned; and the taking of measures to prevent a recurrence of the harm. 2, record 79, English, - satisfaction

An «implied contract» is inferred by the law as a matter of reason and justice from the act or conduct of the parties. An implied contract may arise where one party, without being requested to do so, renders services under circumstances indicating that he or she expects to be paid thereof, and the other party knowing the circumstances, avails himself of the benefit of those services. An implied contract is an agreement which legitimately can be inferred from the intention of the parties as evidenced by circumstances and ordinary course of dealing and common understanding.(Black's Law Dictionary, cited in note 16 of section 5. 16. 5 of the "Guide de la détermination de l'admissibilité"). 1, record 81, English, - implied%20contract%20of%20service

If there is no privilege, or if there is evidence of malice, or if the privilege has been exceeded, the case must then go to the jury.
