OBS

A misdescription affecting the title, value or character of land in a contract of sale may be(1) substantial, so that the property purchased is not that which it was intended to purchase, or(2) slight, so that compensation in money would be proper.

The difference here is that a mark is deceptively misdescriptive simply by improperly describing some aspect of the goods or services, but to be a deceptive mark, there must also be either :(i) an intent to deceive by the mark's owner; or(ii) a likelihood that purchasers will rely on the misdescription.

OBS

Marks which are deceptively misdescriptive, however, cannot be protected or federally registered until they acquire secondary meaning.

Pour que l'interdiction s'applique, il faut que la marque, prise dans son ensemble, donne, comme première impression, une description claire ou fausse et trompeuse.
