A land mortgage is a type of mortgage loan which is used to purchase land or a lot, in contrast with a structure which has been built on a piece of land. Buyers of raw land usually purchase land with the intent of developing it or establishing a structure. Land mortgages are different from mortgages for structures because, from the point of view of a bank, land is a less secure investment. If someone defaults on a land mortgage, the bank will be left with an empty lot which could be difficult to resell.

There is no doubt that under a common-law mortgage the debt did not become extinguished by a foreclosure order. As is well known the old mortgage, which has been known for hundreds of years, was a conveyance of the land to the mortgagee, subject to certain rights on the part of the mortgagor. If the mortgagor failed to pay according to the terms of the mortgage he lost his rights and the mortgagee became the absolute owner of the lands without more.

Although the term "legal mortgage" is inappropriate to a mortgage under the land titles system and is not in fact in common use, the term "equitable mortgage", which under the old system is used in contradistinction to a legal mortgage, is under the new system commonly used to indicate a mortgage or charge other than a registered or statutory mortgage. Under the old system any mortgage subsequent to a legal mortgage is necessarily an equitable mortgage, but under the new system a second mortgage is of the same nature as a first mortgage. In other respects, however, the ordinary rules as to equitable mortgages prevail under the land titles system. Thus, an equitable mortgage may be created by an agreement to execute a mortgage or to charge money on land or by deposit of documents of title.(Falconbridge on Mortgages, 1977, 4th ed., s. 10. 11)

The amount of the loan cannot exceed 75% of the appraised market value of the land and buildings less the amount of any outstanding mortgage. The thing required may be the correction of a title defect, the production of a draft document, a survey, mortgage statement, Land Division Committee consent or any other thing to which the party to the transaction is entitled.
