A land mortgage is a type of mortgage loan which is used to purchase land or a lot, in contrast with a structure which has been built on a piece of land. Buyers of raw land usually purchase land with the intent of developing it or establishing a structure. Land mortgages are different from mortgages for structures because, from the point of view of a bank, land is a less secure investment. If someone defaults on a land mortgage, the bank will be left with an empty lot which could be difficult to resell. 3, record 1, English, - land%20mortgage

There is no doubt that under a common-law mortgage the debt did not become extinguished by a foreclosure order. As is well known the old mortgage, which has been known for hundreds of years, was a conveyance of the land to the mortgagee, subject to certain rights on the part of the mortgagor. If the mortgagor failed to pay according to the terms of the mortgage he lost his rights and the mortgagee became the absolute owner of the lands without more. 3, record 4, English, - common%2Dlaw%20mortgage

2, record 4, French, - hypoth%C3%A8que%20en%20common%20law

Although the term "legal mortgage" is inappropriate to a mortgage under the land titles system and is not in fact in common use, the term "equitable mortgage", which under the old system is used in contradistinction to a legal mortgage, is under the new system commonly used to indicate a mortgage or charge other than a registered or statutory mortgage. Under the old system any mortgage subsequent to a legal mortgage is necessarily an equitable mortgage, but under the new system a second mortgage is of the same nature as a first mortgage. In other respects, however, the ordinary rules as to equitable mortgages prevail under the land titles system. Thus, an equitable mortgage may be created by an agreement to execute a mortgage or to charge money on land or by deposit of documents of title.(Falconbridge on Mortgages, 1977, 4th ed., s. 10. 11) 2, record 6, English, - registered%20mortgage

If A, contemplating the purchase of land from S, grants a mortgage of that land to M before receiving delivery of the deed from S, and subsequently receives a deed, but gives back a mortgage to S as part of the purchase price, the feeding of the estoppel will give M only a title which is subject to S’ s vendor's lien and mortgage. In this example, S is a stranger to the mortgage deed from A to M, and is not affected by any estoppel which M could raise against A. The object of making the requisition may be simply to remind the other party of an obligation under the contract to produce or do some specific thing or it may be to preserve a purchaser's right under the contract with respect to an alleged title defect.("Law Society of Upper Canada, Bar Admission Course, Real Estate Law", 1990-91, p. 8-1). 1, record 11, English, - requisition

Record number: 21, Textual support number: 2 OBS
Surrender is a generic term for all acts of the kind, [mentioned in the definition] but the following specific terms, including surrender itself, are normally used depending on what is surrender : surrender for an estate, lease, patent, insurance policy or physical object; disclaimer, renunciation, for an estate, succession, inheritance or office, especially if not yet vested or if unwanted or burdensome; resignation, reliquishment, for an office; waiver release, for a right of action; waiver renunciation, for a right to attend a meeting, right to receive notice, right to generally to the benefit of an obligation; release for a debt, usually on its satisfaction, e. g. for a mortgage; remission for an unsatisfied debt; discontinuance for the reliquishment and consequent termination of a judicial action by written notice given by a plaintiff, or for the termination of an abandoned action by court order. All the above should be clearly distinguished from abandonment, which is a unilateral and unwritten act of relinquishment, e. g. of a child, a ship, land, a building, goods, or of a judicial action where no notice of relinquishment is given by the plaintiff(in which connection abandonment does not terminate the action if the possibility subsists of it being revived) ;and from forfeiture, which is involuntary. 3, record 21, English, - abdication
