Where a tenant gives notice of his intention to quit the premises by him held at a time mentioned in the notice and does not accordingly deliver up the possession thereof at the time mentioned in the notice, the tenant shall from thenceforward pay to the landlord double the rent or sum that he should otherwise have paid, to be levied, sued for and recovered at the same times and in the same manner as the single rent or sum before the giving of such notice could be levied, sued for or recovered, and such double rent or sum shall continue to be paid while the tenant continues in possession.(R. S. O. 1980, c. 232, s. 59).

Notice of certain facts that may be discovered by diligence or inquiry into a public record; a legal presumption that a person is responsible for knowing these facts. The proper recording of a document gives constructive notice to the world of the document's existence and contents. Possession of property also imparts constructive notice of the rights of the party in possession. Examples of rights of parties in possession would be rights under an unrecorded deed, contract for deed, lease-option, and rights of adverse possession. Constructive notice is also referred to as legal notice, in contrast to actual notice, which is express or direct knowledge acquired in the course of a transaction.(Reilly, 2nd ed., 1982, p. 100).
