There are certain cases in which there is said to be a tenancy by estoppel. If a person with no estate in land purports to grant a tenancy of the land, the grant can pass no actual estate. Yet, even though the lessor's want of title is apparent to the parties, both the parties and their successors in title will be estopped from denying that the grant was effective to create the tenancy that it purported to create(Megarry and Wade, p. 646). 1, record 2, English, - tenancy%20by%20estoppel

(L) egal executory interests... are interests of a kind quite different from those recognized by the common law. As the word "legal" indicates, they are interests that affect legal title. They are "executory" in that they are always contingent and never vested, and when the contingency occurs they vest forthwith in possession and do not pass through the stage of vesting in interest. Moreover, legal executory interests are not subject to the common law remainder rules and in this sense, in contrast with legal contingent remainders, may be termed "indestructible. In parts of the United States, real estate is customarily sold through a process known as an escrow closing. In such a closing, the buyer and seller do not meet face to face for an exchange of documents and consideration; rather, the purchaser deposits with the escrow agent the agreed purchase price and such other documents as may be required, while the seller deposits with the escrow agent the executed deed to the property and related documents. In addition, if financing by a lender is to be provided, the mortgage or deed of trust and its related instruments are also deposited with the escrow agent. When the agent has received all of the necessary documents and cash, it will consummate the transaction and title will pass to the purchaser. Between the time that a document or cash is deposited with the escrow agent and the transaction is consummated, the items deposited are considered to be "in escrow".("The Arnold Encyclopedia of Real Estate", 1978, p. 269) 1, record 7, English, - escrow%20closing

In determining the issue as to the priority of the mortgages, the doctrine of "feeding the estoppel" was considered. This doctrine is invoked when a person has no legal interest in the land at the time of the conveyance. As soon as he acquires title, it "feeds the estoppel" so as to pass his title to the grantee, according to the covenants in the deed, but subject to any limitations or defects in his newly acquired title.(5 R.
