A land mortgage is a type of mortgage loan which is used to purchase land or a lot, in contrast with a structure which has been built on a piece of land. Buyers of raw land usually purchase land with the intent of developing it or establishing a structure. Land mortgages are different from mortgages for structures because, from the point of view of a bank, land is a less secure investment. If someone defaults on a land mortgage, the bank will be left with an empty lot which could be difficult to resell. 3, record 14, English, - land%20mortgage

In the natural state of land one part of it receives support from another, upper from lower strata, and soil from adjacent soil, and therefore if one piece of land is conveyed so as to be divided in point of title from another contiguous to it, or(as in the case of mines) below it, the right to support passes with the land, not as an easement held by a distinct title, but as an essential incident to the land itself.(Halsbury, 4th ed., Vol. 14, p. 82). 2, record 15, English, - support

"delivered at frontier" means that the seller delivers when the goods are placed at the disposal of the buyer on the arriving means of transport not unloaded, cleared for export, but not cleared for import at the named point and place at the frontier, but before the customs border of the adjoining country. The term "frontier" may be used for any frontier including that of the country of export. Therefore, it is of vital importance that the frontier in question be defined precisely by always naming the point and place in the term. However, if the parties wish the seller to be responsible for the unloading of the goods from the arriving means of transport and to bear the risks and costs of unloading, this should be made clear by adding explicit wording to this effect in the contract of sale. This term may be used irrespective of the mode of transport when goods are to be delivered at a land frontier. When delivery is to take place in the port of destination, on board a vessel or on the quay(wharf), the DES or DEQ terms should be used. 3, record 36, English, - delivered%20at%20frontier

4, record 36, French, - rendu%20fronti%C3%A8re

The four unities of a joint tenancy are the unities of possession, interest, title and time.... Unity of possession is common to all forms of co-ownership. Each co-owner is as much entitled to possession of any part of the land as the others. He cannot point to any part of the land as his own to the exclusion of the others; if he could, there would be separate ownership and not co-ownership.(Megarry & Wade, 4th ed., 1975, p. 392). 1, record 39, English, - unity%20of%20possession

Several and concurrent ownership must... be distinguished. The owner of an interest in land may be entitled to possession either alone or in conjunction with other persons, and in both cases he may be entitled to take possession either now or at some time in the future. If he is entitled in his own right without having any other person joined with him in point of interest, he is said to hold in severalty; but where he and other persons have simultaneous interests in the land, they are said to hold concurrently, or in co-ownership, and to have concurrent interests. The essential difference between legal and equitable rights is best understood by comparing absolute ownership with trusts....(A) t this point it is only necessary to appreciate that trusts were unenforceable at common law. If land was conveyed to A in fee simple upon trust for B in fee simple, the common law courts regarded A as absolute owner and would not recognise any rights in B. But the Chancellor would enforce trusts, as matters of conscience, and compel A to hold the land on B's behalf and to allow B to enjoy it. In such a case A is the "legal owner", B is the "equitable owner". The land is vested in A, but since he is trustee of it he is not the beneficial owner : he has only the "bare legal estate", and the beneficial interest belongs to B. Now legal ownership confers rights "in rem", rights of property in the land itself, which can be enforced against anyone. Equitable ownership conferred at first only a right "in personam", a right to compel the trustee personally to perform his trust.(Megarry & Wade, 4th ed., 1975, p. 113). 1, record 42, English, - legal%20ownership

1, record 54, French, - dispositif%20d%27a%C3%A9rolargage%20de%20pr%C3%A9cision

At present... the formation of urban land rent is no longer due to the presence of a large central town. On the contrary, the rents are now determined by the position with respect to areas destined for particular uses or to smaller urban areas. It is shown... that the distance from the nearest commercial and/or industrial area influences the selling price. In particular, for plots without buildings the highest values are in the immediate vicinity(Lit 8 148/m² at less than 2 km), while they gradually decrease as the distance increases, almost halving at distances of more than 6 km. The same can be said for distance from the nearest village. The plots furthest away cost almost Lit 18 million/haless than those in the immediate vicinity.... Vicinity to a dump has a greater effect than that of poor access. It is clear that being close to dumps almost totally eliminates the building suitability of the land, at least from an urban residential point of view. This allows the effect of the urban land rent on agricultural land in metropolitan areas to be estimated. If the value of a 2 ha plot of land, sited near an industrial or commercial area and with good access, is estimated with model C to be about Lit 77 million/ha, the value of a plot of the same size situated 9km away, near a dump and accessible by a dirt track or across the end of a field, would be about Lit 28 million/ha. 2, record 60, English, - urban%20land%20rent
